Benchmark Monitoring Actions—Data exceeding benchmarks <br /> i) If the averaged monitoring values for any parameter,at a specific outfall,exceeds the benchmark,as described in <br /> a)through c) below,the permittee must conduct corrective action in accordance with Part LK—Corrective Actions <br /> of this permit. <br /> a) The average of the initial 4 quarterly sample monitoring values for any parameter exceeds the <br /> benchmark. <br /> b) If less than 4 benchmark samples have been taken, but the sum of the quarterly sample results to date is <br /> more than 4 times the benchmark level(i.e.,an exceedance of the 4 quarter average is mathematically <br /> certain),this is considered a benchmark exceedance. <br /> c) If any of the annual samples taken after the first 4 quarterly samples(i.e.,samples 5 through 8),when <br /> averaged with the proceeding samples,causes an average monitoring value that exceeds the benchmark <br /> for any parameter,this is considered a benchmark exceedance. <br /> ii) Following control measure(s)modification,the permittee must continue quarterly monitoring for 4 additional <br /> quarters. For this monitoring: <br /> a) if the average of the monitoring values for any parameter does not exceed the benchmark,the permittee <br /> may monitor once-per-year as described in Part 1.1.2.d,above. <br /> b) If the average of the monitoring values for any parameter still exceeds the benchmark(or if an <br /> exceedance of the benchmark by the 4 quarter average is mathematically certain prior to conducting the <br /> full 4 additional quarters of monitoring),the permittee must again conduct corrective actions consistent <br /> with Part LK(Corrective Actions)of this permit unless the Division waives the requirement for additional <br /> monitoring and corrective action. <br /> 3. Water QualitV Standards Monitoring <br /> a. Applicability of water quality standards monitoring <br /> Consistent with the provisions in Part I.C.2.,the Division may apply monitoring conditions(i.e.,sampling parameters, <br /> sampling frequency,and sample type)in the permit certification issued to a permittee for discharges to impaired waters, <br /> discharges to waters designated as critical habitat for threatened and endangered species,and other discharges as <br /> necessary to determine if compliance with the other terms and conditions of the permit will control discharges as necessary <br /> to meet water quality standards. Monitoring conditions will be consistent with applicable water quality standard(s)for the <br /> receiving water,and as applicable,the assumptions of any available wasteload allocation in an applicable TMDL. Water <br /> quality standards monitoring is only required at a facility if specified in the certification. <br /> b. Monitoring Frequency and modification <br /> When specified in the certification,the permittee must monitor discharges once per quarter at each outfall(except <br /> substantially identical outfalls)discharging stormwater to impaired waters. <br /> c. Modifying Monitoring Requirements <br /> A permittee may request modification of the water quality standards monitoring requirements required by the permit <br /> certification if,after one year of monitoring or 4 samples,a pollutant,at a specific outfall, is not detected above the <br /> applicable,end-of-pipe water quality standard in any sample. <br /> 4. Additional Monitoring Required by the Division <br /> The Division may notify a permittee of additional discharge monitoring requirements. Any such notice will briefly state the <br /> reasons for the monitoring,locations,and monitoring parameters,frequency and period of monitoring,sample types,and <br /> reporting requirements.Such monitoring may include salinity and in-stream sampling and whole effluent toxicity testing. <br />
