Mr. Fontanari’s property was inspected for successful revegetation on <br />areas disturbed by mining activities, as well as all accessible acres of the property that were over mine workings <br />from the Roadside Portals Mine. The inspection was conducted on August 14th throu gh August 16th, 2018. The <br />inspection was completed by Clayton Wein, Brock Bowles and Dan Hernandez of the Colorado Division of <br />Reclamation, Mining and Safety (the Division). Tonya Hammond of snowcap Coal Company (SCC), Jim Stover <br />of J.E. Stover and Assoc iates , and John Justice (Present on August 14th and 15th) and his associate Karoline <br />Henning (Present on August 16th) represented SCC at the inspection. The land owner, Rudy Fontanari, was <br />represented at the inspection by Jim Beckwith, Ken Walter of Walter Environmental and David Fox. Prior to the <br />inspection, a survey grid was created using ArcMap and ArcOnline. Field instrumets that were used to collect <br />data include an Iphone 6 and a Panasonic Toughbook that utilized the ArcCollector program. A BADELF GPS <br />unit was paired withthe Iphone to follow and map thr rout e taken on the survey grid. The Panasonic was paired <br />with an Arrow Gold GPS unit to record features allong the survey grid as transects were completed. The weather <br />was clear on the 14th and 16th and cloudy skies on the 15th. The ground conditions were dry. Temperatures for <br />the inspection ranged from the low 80s to the high 90s. <br />The reclaimed surface disturbances inspected for Phase II and Phase III criteria on Mr. Fontanari’s property <br />include the Light Use Road # 1 (1.1 acres ) and the Substation A (0.2 acres). Phase II criteria for the Light Use <br />Road #1 and the Substation A was the establishment of vegetation in support of the post mining land use of fish <br />and wildlife habitat. These areas do not have a topsoil depth requirement. The North Decline and the Borrow <br />Area are located on Mr. Fontanari’s property and were inspected for the Phase III criteria of ; achieving the post <br />mining land use of fish and wildlife habitat, and the protection t o the hydrologic balance. The area requested for <br />the North Decline is 6.6 acres. The Borrow Area is 1.1acres in size. <br />FISH and WILDLIFE – Rule 4.18: <br /> During the inspection, deer scat was observed at several locations. Animal burrows were also frequently <br />observed.
