The inspection was completed <br />by Clayton Wein of the Division of Reclamation, Mining and Saftey (the Division). Scott Wanstedt of Blue <br />Mountain Energy (BME) accompanied the inspection. The weather was cloudy with an occasional drizzle. The <br />temperature was 38 degrees F. The ground conditions were wet and muddy. <br />BACKFILL and GRADING – Rule 4.14 <br />Contemporaneous Reclamation 4.14.1; Approximate Original Contour 4.14.2; Highwall Elimination 4.14.1(2)(f); <br />Steep Slopes 4.14.2, 4.27; Handling of Acid and Toxic Materials 4.14.3; Stabilization of Rills and Gullies 4.14.6: <br /> During the inspection, a degas borehole pad was visited. The Deserado Mine has obtained approval from <br />MSHA to discontinue the use of degas boreholes. The pad had been constr ucted for the borehole, however, the <br />borehole itself was not constructed. The pad was scheduled to be regraded and reseeded. <br /> <br />FISH and WILDLIFE – Rule 4.18: <br /> During the inspection, a Bobcat was seen running across an access road to the rail loop. Ducks were <br />observed at the PP -2 pond and the B-Seam #1 Dewatering System. A group of deer were seen when inspecting <br />the Slot Storage Ponds. <br /> <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Struc tures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage – Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br /> Ditches and culver ts around the B Portals facilities area were inspected. All culverts were clear o f debris <br />and functioning as designed. The ditches were in good repair and functioning. Water was being diverted from the <br />facilities to the DP -1 pond. There were no blockages or erosional issues spotted. The ditches and culverts in the <br />facilities area will be cleaned as necessary throughout the season. The DP -1 pond was impounding water at the <br />time of the inspection (Photo 1). The embankment of the pond was well vegetated and stable. The pond was <br />observed to be discharging through the primary spillway into Scullion Gulch. The primary spillway was clear of
