RECLAMATION '' Lessee shalt submit at[ plans for restoration and reclamation of Leased Premises to <br /> Lessor for Lessor's approval before submitting the appropriate permit nr permits pursuant tothe <br /> Colorado Mined Land Reclamation Act 34']Z'101 ETSEO.' [.R.5. as amended, and all reports required <br /> hv Lake County. Rules and regulations asset forth by Division of Reclamation, Mining and Safety <br /> (DRMS) for recovery and restoration Of mined [and shall apply where applicable to the Leased Premises. <br /> Elements nf the reclamation plan shall include but not belimited to: <br /> a) Final reclamation nnuSL not preclude the future use of the property asa water storage reservoir, <br /> but shall otherwise meet ail. requirements Of the Colorado Mined Land Reclamation Act and any <br /> other applicable taws and regulations. Lessee shalt not rely 0n any proposed future use toavoid <br /> any reclamation requirements. <br /> b) Contouring map showing approximate contours that wilt exist upon final reclamation. Final slopes <br /> shalt be aesthetically pleasing and natural incharacter, but in all cases shall beno steeper than <br /> 3h:lv. Modifications to the originally approved contour map may be allowed if it is in the best <br /> interest of Lessor and Lessee, or if reasonably necessary to comply with state, federal Or i0Cai <br /> permits. <br /> c) Backfill. operations shall be conducted to maximize compaction to the extent practicable. <br /> d) All mined areas shall be mapped on a master map and the depth and type of backfitt and the <br /> prominent survey points shalt be depicted on the map. The map will also depict geologic and <br /> hydrologic conditions encountered during mining orexploration. As mining operations are <br /> completed and the areas are no longer needed for the operation, and future mining adjacent to <br /> that land will not adversely affect the success Ufreclamation, the mined land wilt beb8ckfiKed, <br /> graded, Lnpsoiied. and rev9getdted. <br /> B) When stripping topsoil, if another parcel iS ready tO receive soil, that freshly stripped soil wilt be <br /> placed on that parcel to take maximum advantage of the seed bank within the freshly stripped <br /> soil. Topsoil piles standing for more than six months shalt be seeded with an appropriate seed mix <br /> to prevent erosion. <br /> f) Control of noxious weeds shalt be implemented on aR land disturbed as a consequence of the <br /> mining operation. <br /> Variations from the re[(OnnabVn plan as originally submitted to the Lessor for approval may be <br /> granted only with the written approval of Lessor. <br /> 20. -- Whenever approval by Lessor is required or contemplated by Lessee, approval <br /> must be in writing and shall be optional and shalt be within the sole and absolute discretion of Lessor. <br /> Lessorvviii make best efforts to provide notice ofapproval or disapproval within 45 days Vfthe <br /> receipt ofawritten request for approval from the Lessee. <br /> 21' OTHER STATE AGENCIES -- Lessee shall notify and give Lessor full rights to access to any documents <br /> filed with any other federal, state, or local government entity which relates in any way to this Lease or <br /> the Leased Pn2nnis8s' <br /> Page 9of18 <br />
