review compliance annually and notice Lessee on non-compliance issues and terminate this Lease if <br /> compliance is not forthcoming within one year after notice is issued unless conditions warrant a shorter <br /> time period and that period is included in the above referenced written notice to Lessee. If the non- <br /> compliance issue requires more than one year to remedy, Lessee shall request additional time in <br /> writing and diligently pursue compliance and demonstrate such to Lessor. The Mining Et Operations <br /> Plan will include, but not be limited to the following: <br /> a) Shall provide for the orderly, logical development of the Leased Premises in conjunction with <br /> the development of adjacent lands subject to Lease. <br /> b) To the greatest extent practical, the Leased Premises shalt be mined before the lands leased <br /> from the City of Aurora. Further, to the greatest extent practical, the lands leased from City of <br /> Aurora will be mined from east to west. Lessee must differentiate between those minerals mined <br /> from the Leased Premises and those minerals mined from City of Aurora lands, and ensure proper <br /> accounting for minerals mined from each lease. <br /> c) A weed control plan to be approvabte by Lessor that must comply with the Colorado Noxious <br /> Weed Act, 5 35-5.5-101, et seq., C.R.S., as amended. Weed control will only be required on lands <br /> disturbed by Lessee, unless it is determined that undisturbed lands have been impacted due to <br /> Lessee's activities on site. <br /> d) Plans for regulatory compliance, including requirements of the Colorado Department of Public <br /> Health and Environment (CDPHE), Colorado Parks Et Wildlife (CPW), U.S. Army Corps of Engineers <br /> (COE), Colorado Division of Reclamation, Mining and Safety (DRMS) and any other federal, state <br /> or local agency with jurisdiction over operations of this type, including but not limited to Lake <br /> County. <br /> e) To the greatest extent practical, the operation shall be designed to minimize visual impacts <br /> from U.S. Highway 24 and Lake County Road 10. <br /> f) Operations and reclamation shalt not materially impair the use of the property as a water <br /> storage reservoir after termination of the Lease. <br /> g) All areas proposed for disturbance shall be surveyed for a rare variety of the native <br /> wildflower, Meadow Blazing Star (Liatris ligutistylis). if identified, these areas should be avoided <br /> to the greatest extent practical. <br /> h) An outline form of the Reclamation Plan (the complete reclamation plan is required under <br /> Paragraph 19), such Reclamation Plan to include provisions for grading and contouring Leased <br /> Premises. <br /> i) Provisions and plans to conclude mining and reclamation activities prior to the termination of <br /> the Lease. <br /> 18. ENVIRONMENTAL ANALYSIS -- Lessee shall comply with all applicable federal, state, and local laws, <br /> rules, regulations, permits, codes and ordinances to identify and reduce adverse impacts to the <br /> environment, and the public health, safety and welfare, including the rules, regulations and <br /> requirements of the DRMS. <br /> Prior to any surface occupancy on the Leased Premises, Lessee must perform environmental analyses <br /> that are required by any local, state or federal agency or regulation.
