The changed Home Ditch water right is the primary source of water to allow gravel <br /> operation use during both the Irrigation/Non-Irrigation Season, and to augment such uses. The <br /> original point of diversion was washed out several years ago, and the owner of the ditch moved <br /> the point of diversion upstream,without going through a court action for a change of water right. <br /> Home Ditch will be dried up,as follows: <br /> 1. Dry-up of Land. Applicant shall: (1)dry up sufficient land to provide the <br /> consumptive use credits for the augmentation plan hereunder, historically irrigated by the 2.0 cfs <br /> of Home Ditch water rights; (2) fill and destroy all ditches and laterals historically irrigating this <br /> land; and (3) monument said dry up area, all in accordance with the instructions and to the <br /> satisfaction of the Division Engineer, with a courtesy copy to DWCD. The dry-up area and the <br /> area to be irrigated from the Home Ditch are depicted in Exhibit A. These areas will be staked or <br /> otherwise marked in the field by the Applicant, to the satisfaction of the Division Engineer to <br /> allow the Water Commissioner to verify the areas. Permanent dry-up must be filed with the clerk <br /> and recorder's office for the county wherein the land is located and a copy of the recorded <br /> instrument submitted to the Division Engineer. Any temporary dry-up may be made for a term <br /> of not less than one irrigation season. <br /> 2. Accguntine. Applicant shall provide monthly accounting to the Division <br /> Engineer on a form acceptable to the Division Engineer,with yearly accounting to DWCD. <br /> 3.- DWCD Lease. if at any time there are not sufficient HCU credits <br /> available to offset the depletions associated with mining activity, the Applicant shall lease water <br /> from DWCD or other legal supply. <br /> D. Future Development. Upon conclusion of mining and determination of specific <br /> post mining plans,Applicant may seek amendment of thus plan upon resume notice. <br /> CONCLUSIONS OF LAW <br /> 8. The foregoing findings of fact are fully incorporated herein by reference. <br /> 9. The Division Engineer is lawfully required to administer diversions under the Water <br /> 2 <br />
