RE: Acreage Release Request for Fort Lupton Sand & Gravel Mine, M-1999-120 <br /> Willow Lake phase and Deep Lake phase <br /> L.G. Everist requests release of the entire 51.20 acres of the Willow Lake phase, and 4.58 acres of the <br /> Deep Lake phase. These areas have not been disturbed or mined, and have remained in a natural, <br /> riparian state. In 2012, when L.G. ,Everist amended the Fort Lupton permit to include all these areas, <br /> we hoped to mine some of it, but we later realized that mining the riparian areas was not practical and <br /> so decided not to disturb it. <br /> Additionally, after completing our permit amendment with the DRMS in 2012, L.G. Everist annexed <br /> these properties (and more) into the City of Fort Lupton in 2013. In the Annexation Agreement with the <br /> City of Fort Lupton, L.G. Everist agreed to dedicate Willow Lake - otherwise known as Lot 3 of the <br /> Everist South Minor Subdivision - to the City of Fort Lupton by December 31, 2018, for the City's Parks <br /> and Public Lands. As part of the annexation agreement, the City of Fort Lupton wanted L.G. Everist to <br /> get Lot 3 released from the DRMS permit prior to the dedication and transfer of the property from L.G. <br /> Everist to the City. <br /> As mentioned above, the DRMS phase area boundaries of Willow Lake and Deep Lake are slightly <br /> different than the "Willow Lake" parcel areas legally described as Lot 3 in the Everist South Minor <br /> Subdivision. The north end of Lot 3 extends into the south end of the DRMS permit area known as <br /> Deep Lake. These areas are shown on the attached maps. <br /> Because these areas have not been disturbed by mining, there is no reclamation to be completed. <br /> Property markers and fences are present along the north, west and south borders to show the <br /> boundaries of the area to be released. Although the eastern parcel boundaries are across the South <br /> Platte River in some instances, L.G. Everist has always used the river to be our eastern-most <br /> boundary, and we have not affected or disturbed any of the property across the river. <br /> Parker-Adams phase - section east of Lupton Bottom Ditch <br /> L.G. Everist would like to release 8.44 acres of the 9.44 acres of the Parker-Adams phase that is east <br /> of the Lupton Bottom Ditch. This area has not been disturbed by mining operations and will not be <br /> mined. We need to keep 1 acre (of the 9.44 acres located to the east of the ditch) in the permit <br /> because it is a recorded easement for the access road on the east side of the Ditch - or more precisely, <br /> 30 feet from the centerline of the ditch to the east. <br /> When L.G. Everist amended the DRMS permit for the Fort Lupton Sand and Gravel site in 2012, we <br /> included the entire Parker-Adams property within the DRMS permit limits, but we never planned to mine <br /> this area, as can be seen in the Exhibit C-1 Mining Plan Map (2012) attached for reference. Since the <br /> 2012 permitting, this area has been legally subdivided and sold, so L.G. Everist no longer owns it.
