Everist, Incorporated (L.G. Everist), as Perm ittee/Operator respectfully submits this Acreage
Release Request for a total of approximately 64.22 acres of the Fort Lupton Sand and Gravel mine,
DRMS Permit M-1999-120. Please see the attached Division of Reclamation, Mining and Safety's
(DBMS) form, Request for Full or Partial Release of Permit Area/Surety Reduction.
L.G. Everist requests release of undisturbed and un-mineable areas of the Fort Lupton Sand and
Gravel Mine (M-1999-120) that are generally adjacent to the South Platte River and east of the Lupton
Bottom Ditch. The permitted acres to be released are within the following phases and include:
- Willow Lake phase - approximately 51.20 acres - this is the entire phase, which is completely
undisturbed by mining activities.
Note: Upon release this undisturbed, riparian area consists of two legal parcels that are being
dedicated (by 12131118) to the City of Fort Lupton for the City's Parks and Public Lands.
- Deep Lake phase - approximately 4.58 acres - this is in the south part of this phase -these acres
are undisturbed by mining activities.
Note: This small section of the Deep Lake phase is also an undisturbed, riparian area. Part of this
area is the remaining part of the northern legal parcel that makes up the the Willow Lake area that
L.G. Everist is dedicating to the City of Fort Lupton. (The DRMS phase boundaries are slightly
different than the underlying legal parcel boundaries.)
- Parker-Adams phase - approximately 8.44 acres - these acres are located on the east side of the
Lupton Bottom Ditch - and are undisturbed by mining operations.
Note: This 8.44 acre area to the east of the Lupton Bottom Ditch (9.44 acres minus 1.00 acre of
recorded easement for the access road on the east side of the Ditch) is no longer owned by L.G.
Everist, and has been separated into 3 private residential properties.
Please see the following pages for maps and more details on the acreages to be released.
FL-DRMS-Acre Red ucReq-WdlowLake&Deep Lake&Parke rAdams-toES-Sep2018.docx-Certified/Return Receipt 7016 1370 0001 0670 4126
