court to control the disposition of causes on its docket with economy of time and effort for itself, <br />for counsel, and for litigants." Id.; see also In re Application for Water Rights of U.S., 101 P.3d <br />1072, 1082-84 (Colo.2004) (holding water court acted within its discretion in granting stay of <br />proceedings until resolution of related federal litigation, due to considerations of comity as well <br />as the relief available to the parties). <br />2. During the pendency of both this action, to the extent Plaintiffs' claims <br />concerning MR -82 to Permit No. C-1981-041 (the "Permit") are pending, and the Judicial <br />Review Action, including any requirements dictated by any appeal of that action, Snowcap will <br />not make any of the repairs contemplated in TR -69 to the Permit, including but not limited to <br />installing any concrete plug, or related material or alteration, in the airshaft or mine workings <br />identified in TR -69; <br />3. During the pendency of both this action, to the extent Plaintiffs' claims <br />concerning MR -82 to the Permit are pending, and the Judicial Review Action, including any <br />requirements dictated by any appeal of that action, Plaintiff will not flood irrigate any portion of <br />Tract No. 71, or deliver water to Tract No. 71 in an open ditch. Plaintiff may only utilize a drip <br />irrigation system (supplied by approximately 600 feet of 12 inch pipe) on Tract No. 71. The drip <br />irrigation system will be located in the southeast portion of Tract No. 71 and will be connected to <br />the Martin Crawford Pipeline. That system includes valves and will be flushed at the end of the <br />watering season into Carey Pond. Prior to any flushing of the drip irrigation system on Tract No. <br />71, Plaintiff agrees to provide 48 hours' notice to Defendant Snowcap through counsel for <br />Snowcap. <br />4. Plaintiff further agrees not to disturb the flagging that Snowcap has installed on <br />Tract No. 71 near the airshaft and TR -69 repair area.
