Request for Partial Release <br /> Vollmer Pit <br /> Permit M-1983-035 <br /> Schmidt Construction Company <br /> September 10, 2018 <br /> A partial release of permitted land at this operation is requested as shown on the attached release <br /> request form and accompanying map. This release is in addition to the release approved earlier <br /> in 2018. In effect, when approved,this release will complete the release of all the unmined land <br /> east of the actual Vollmer Pit, except for a 50 foot wide strip immediately adjacent to the east <br /> edge of the pit. That 50' strip will allow for access to the eastern cut faces of the pit for <br /> reclamation as needed. <br /> As the attached map shows,the previous release did not include this area for two reasons. First, <br /> was to leave a wide corridor for access to the two berms which are, in fact, affected land. <br /> Second,the corridor would provide a wide zone for equipment to operate without a risk of <br /> crossing the release boundary which would become the new permit boundary. Of course, <br /> crossing that boundary is affecting land outside the permit which is not allowed and could be <br /> cited as a violation. <br /> Subsequently, a meeting on August 27, 2018 was held between the Division, Schmidt <br /> Construction, and Turkey Canon Quarry Inc., the new landowner. In that meeting the landowner <br /> presented their plans for the property which included starting a residential development on the <br /> east end of the Vollmer Pit property, probably within one year. As it was largely undisturbed <br /> land they believed it should all be released. Unfortunately, there are those berms which are <br /> affected land and cannot normally be released until they are considered reclaimed. <br /> It was agreed in the meeting that the berms were effectively reclaimed. (Please see TR 05 for <br /> this operation). In that Technical Revision it explains why this is true and also fulfills a request <br /> by the landowner to leave the berms for their use. This action opens the door for a release of <br /> those portions of the berms that are within the area the landowner desires to develop. That <br /> release land effectively includes the corridor around the west end of the earlier release, except <br /> for the 50 foot wide strip. And with this release the landowner can proceed with developing the <br /> east end of the Vollmer Pit property as it will no longer be a part of the permit. Excess earth <br /> removed from the development of the eastern land that is not utilized there will go into the pit as <br /> backfill in accordance with a future amendment that will address the reclamation of the <br /> remainder of the pit. <br /> Page 1 of 1 <br />
