Reilley, MS, GISP <br />SL9 4 <br /> <br /> <br />The Division received CEC’s Phase I bond release application SL9 on 21 April 2017, and found the <br />application complete on 22 May 2017, after the Division received proof of publication of the applicant’s <br />public notice. The completeness determination was made in accordance with Section 3.03.2(1)(d). The <br />map entitled Vegetation and Revegetation, submitted with the application, shows the location of each <br />parcel. <br /> <br />The bond release comprises two areas; area 33, approximately 12.46 acres seeded in 2015 and area 34, <br />approximately 6.93 acres seeded in 2016 for a total acreage of 19.39 acres. <br /> <br />Public Notice <br /> <br />CEC published notice of the bond release application in the Fort Lupton Press once weekly for four <br />consecutive weeks, beginning on 26 April 2017. CEC also notified landowners within and adjacent to <br />the mine permit area, and other interested parties, of the application for bond release, as required by <br />Section 3.03.2(1). The Division received no written comments, objections, or requests for an informal <br />conference regarding the bond release application. <br /> <br />Bond Release Inspection <br /> <br />The Division scheduled and conducted a bond release inspection on 21 June 2017 and a second inspection <br />on 14 September 2017. Both site inspections were conducted in accordance with Rule 3.03.2(2). Present at <br />the June inspection were Danny Kipp with Coors Energy Company, and Robin Reilley and Jason Musick <br />with the Division of Reclamation Mining and Safety. The Division notified the Office of Surface <br />Mining (OSM) and other land owners (Waste Management of CO and WJW Properties LLC) of the <br />inspection via certified mail on June 9, 2017. <br /> <br />Due to technical problems associated with instrumentation for collecting elevation data on the 21 June <br />inspection, an additional inspection was conducted 14 September 2017. The September inspection was <br />also conducted in accordance with Section 3.03.2(2) and represents the definitive bond release inspection <br />evaluating post-mine topography on the SL9 parcels. Details of the Division’s observations during the <br />inspection can be found in the inspection report issued by the Division 29 September 2017 and the <br />Findings Section of this document. <br /> <br />Danny Kipp with Coors Energy Company, and Robin Reilley with the Division of Reclamation Mining <br />and Safety performed the September inspection. On 29 September 2017, DRMS sent the SL9 bond <br />release inspection report to CEC, OSM and Waste Management of Colorado. <br /> <br />Adequacy Review <br /> <br />Issues discussed during the inspection consisted of the flatness of the landscape and associated challenges of <br />validating topography with a hand-held GNSS (Global Navigation Satellite System) device. This GNSS <br />instrument was on loan from the US Office of Surface Mining’s Western Region Office. No problematic
