Western Water & Land, Inc. <br /> June 6,2017 <br /> Ms.Megan Sullivan <br /> Colorado Division of Water Resources <br /> 1313 Sherman Street,Suite 818 <br /> Denver,CO 80203 <br /> Amendment to Substitute Water Supply Plan Renewal Request for <br /> Maryland Creek Ranch Gravel Pit <br /> Dear Ms. Sullivan: <br /> Western Water&Land,Inc.,on behalf of Peak Materials(a subsidiary of Kilgore Companies),is <br /> submitting this amendment to the January 23,2017 Substitute Water Supply Plan renewal request for <br /> the Maryland Creek Ranch(MCR)gravel operation in Summit County,CO.The renewal request was <br /> submitted to the Colorado Division of Water Resources by Resource Engineering,Inc.on behalf of <br /> Everist Materials,LLC(Everist).Kilgore Companies recently acquired Everist and as a result, Peak <br /> Materials is the current operator of the MCR gravel pit.This amendment affects only the management <br /> of groundwater pumped from Cell 4 during dewatering operations;no other changes are being made to <br /> the renewal request. <br /> It is noted in the renewal request that dewatering will be performed to support mining operations at Cell <br /> 4 and that groundwater pumped from Cell 4 will be discharged to the adjacent Cell 3. Following <br /> submittal of the renewal request,Peak Materials recognized that use of Cell 3 during dewatering may <br /> be limited because of ongoing reclamation and development operations at Cell 3 as well as <br /> uncontrolled inflows to Cell 3 from an un-named intermittent drainage,locally referred to as Vendett <br /> Creek,in response to irrigation return and intermittent runoff. Therefore,minor changes are being made <br /> to the water management procedure outlined in the renewal request to allow the flexibility needed to <br /> accommodate changing conditions and ongoing operations at Cell 3. <br /> Please replace the last sentence on page 2 of the renewal request with the following paragraph: <br /> "Groundwater pumped from Cell 4 will be discharged to the adjacent Cell 3;however,water <br /> may be periodically pumped from Cell 3 and/or discharged directly from Cell 4 to an <br /> approximately 2.0-acre infiltration basin adjacent to the northeast corner of Cell 4.Water <br /> pumped from Cell 3 will be discharged through an existing culvert beneath State Highway 9 to <br /> an infiltration channel along the north side of the highway where the water will infiltrate, <br /> recharging the alluvial aquifer.Any surface discharges from the Cell 4 infiltration basin will be <br /> conveyed in an infiltration channel across the adjacent pasture lands.Any water that does not <br /> infiltrate prior to reaching Maryland Creek will be diverted as necessary to mitigate dewatering <br /> impacts by maintaining water levels in the pit wells and associated wetland areas within the <br /> former Love Pit,located immediately northeast of Maryland Creek Ranch on land owned by <br /> Eagles Nest Mountain Ranch, LLC ." <br /> pphc•.rrrnn.m h"11-th 743 Huniim Court 1UItC 330,0%111d J MICtiutt,(10 81 00 <br /> PhunC: (977))242-0170 Fay- (970)242-0270 <br />
