Creek, South Rock Creek, Old Whetstone Sheep Creek, and McKay ditches in order to help maintain
historic return flows associated with ditch losses and irrigation. This agreement was amended in 1994 to
increase the amount of augmentation water to 39 AF/year. A second amendment was executed in 1998 to
further increase the water service amount to a total of 84 AF/year. Of this total, 17.37 AF are to be used for
augmentation of out-of-priority depletions for the Love Pit, per the terms set forth in Case No. 96CW0176.
An additional 6.0 AF of Green Mountain Reservoir water are required per the terms of Everist's contract
with Summit County for 4.3 AF of Dillon Reservoir water(see Section 3.3 below). The remaining 60.63 AF
are available to be used as replacement water for Everist's depletions corresponding to its MCR operation.
Everist submits a water demand schedule to the USBR on an annual basis. The schedule, which includes
MCR's anticipated monthly diversions, is used to determine how much water should be released from
Green Mountain Reservoir for contractors. A copy of the most recent schedule (July 2016-June 2017) is
included in Attachment H.
3.3 DILLON RESERVOIR
An agreement entered with Summit County provides Everist with 4.3 AF/year of the County's augmentation
pool in Dillon Reservoir. Of this amount, 1 AF/year is dedicated to the operation of the plan decreed in Case
No. 96CW0176. Therefore, 3.3 AF/year of Dillon Water remain available for augmentation of MCR
depletions to the Blue River. No releases of Dillon Water will be required for augmentation of 2017 and
2018 depletions.
4.0 OPERATION OF PLAN
Depletions to the Blue River occur as a consequence of gravel mining operations in MCR. Specifically,
depletions to the Blue River result from evaporation of exposed groundwater, water removed from the River
13 :::::RESOURCE
