TOWN OF GRANBY <br /> BOARD OF TRUSTEES <br /> RESOLUTION 2010-07-13D <br /> A RESOLUTION APPROVING A <br /> CONDITIONAL USE PERMIT FOR A GRAVEL PIT OPERATION <br /> SUBJECT TO CONDITIONS <br /> (Reelamation Ridge,LLC) <br /> WHEREAS, Reclamation Ridge, LLC a Colorado limited liability company ("the <br /> Applicant")is the owner of real property described on Exhibit A, attached hereto("the Property") <br /> containing 72.122 acres,more or less;and <br /> WHEREAS,the Applicant has petitioned the Town of Granby to annex an area that includes <br /> the Property and other lands,into the Town; and <br /> WHEREAS,for several years prior to petitioning to annex to the Town,the Applicant has <br /> operated a gravel pit on the Property;and <br /> WHEREAS,the Applicant desires to continue to operate a gravel pit on the Propei-ty <br /> after it is annexed to the Town,if such annexation is approved by the Town; and <br /> WHEREAS,it is the contemplation of the Applicant and the Town,that if the Property is <br /> annexed to the Town,it will be zoned Industrial Zone District(.1); and <br /> WHEREAS, under the provisions of the Granby"fawn Code operation of a gravel pit in <br /> the Industrial(1)Zone District is permitted as a conditional use;and <br /> WHEREAS, the Applicant has submitted an application pursuant to Section 16-6-1 and. <br /> 16-6-2 of the Granby Town Code seeking a conditional use permit to operate a gravel pit on the <br /> Property;and <br /> WHEREAS,the Planning Commission considered the Application at its regular meeting <br /> on March 1,2010 and,based on the Application and the comments provided at such meeting,the <br /> Planning Commission adopted Resolution No.2010-03-01,recommending approval of the <br /> application subject to conditions,and <br /> WHEREAS,the Board of Trustees considered the Application at its regular meeting on <br /> July 13,2010 and,based on the Application and the comments provided at such meeting,the <br /> Board of Trustees makes the following findings.
