Technical Revision (TR-28) Climax Molybdenum Company
Environmental Protection Plan Permit No. M-1977-493
Other state and federal agencies that regulate or oversee activities at Climax include the Colorado State
Engineer (dam safety and water rights), Colorado Hazardous Materials and Waste Management Division
(within CDPHE), Mine Safety and Health Administration (MSHA), U S Environmental Protection Agency
(EPA), and the U.S. Army Corps of Engineers (ACOE). Since lands within the DRMS permit areas are
privately owned, there is no federal land management agency regulation of the site. The singular
exception to this private land ownership is the Humbug extension of Supply Canal No. 1, which is located
on U.S. Forest Service (USFS) land and permitted with a Special Use Permit from the USFS. The USFS
administers lands surrounding Climax.
Specifics of environmental protection measures and monitoring as required by Rule 6.4.21(3) are
discussed in Section T-2.2 and in Sections T-5, T-6, and T-7 herein.
T-2.2 Specific Permits and Authorizations
Climax operates under numerous specific regulatory permits and authorizations. Permits pertaining to
environmental controls are regulated by the State of Colorado and some federal agencies and are public
information. Copies of these permits and authorizations are available at the agencies listed and in the
Climax Environmental file system. Table T-1, below, lists the permits and authorizations for Climax
related to this EPP as of the date of this plan revision.
Table T-1: Climax Mine Permits and Authorizations
Agency/Organization Applicable Permit or Description
Authorization
Colorado Department of Public Construction Permit Initial Facility-wide air emissions permit
Health and Environment—Air Approval covering all equipment/activities
Pollution Control Division No. 04LK0977 associated with the mine and mill
Colorado Department of Public Colorado Discharge Permit Permit for mine drainage
Health and Environment—Water System (CDPS) Individual Permit treatment system discharges to
Quality Control Division No. CO-0000248 Tenmile Creek
Colorado Department of Public CDPS General Permit No. COR- Permit for storm water discharges
Health and Environment—Water 040178 associated with metal mining
Quality Control Division operations and mine-waste
remediation
US EPA and Colorado Department General Permit No. COG-650110 Permit to generate and apply
of Public Health and Environment— composted biosolids for
Water Quality Control Division reclamation purposes
Colorado Division of Reclamation, Reclamation Permit No. M-1977- Reclamation Permit for Climax
Mining and Safety 493 Mine
Colorado Division of Reclamation, DRMS Permit No. M-1977-493 - Technical Revisions to
Mining and Safety Technical Revisions Reclamation Permit for Climax
Mine
United States Department of Hazardous Materials Certificate of Registration with US DOT as
Transportation Registration required for shipping hazardous
materials
Colorado Department of Public Hazardous Waste EPID No. COD Registration with CDPHE as
Health and Environment- - 0730407421 Small Quantity Hazardous Waste
Hazardous Materials and Waste Generator
Management Division
Eagle County Planning Department Resolution 2008-081 - 1041 Land use permit for Robinson
Permit Approval Pump Station project
Summit County Planning 1041 Permit Approval PLN 12-014 Land use permit for Property
Department Dischar e Water Treatment Plant
Summit County Board of County Resolution 2014-51 Approving Certification of Designation to
Commissioners Certificate of Designation operate biosolids composting
o eration
EPP: Version R4 T-6 August 2018
