10/5/17
Mr. Montgomery, USACE
located at the toe of the access road and might be that band. There's no certainty that the
absence of emergent plants in that band are either the result of seasonal dewatering or
perhaps never survived. But survival of the diverse species is a large part of Concern A,
listed on Figure 1. Is intermittent saturation by the groundwater recharge effort
sufficient to sustain the planted emergent species in that zone, or should it be a
continuous supply?
Concern B—Water Suaaly to the South Pond Durina Minina of Lake 5 and After Closure
The May 2010 revision of the Reclamation Plan shows that the post-reclamation
water surface elevation of Lake 5 will be 8530. The water surface elevation of the South
Pond measured in 2004 was 8529.8, or only 2 '/2 inches lower than the elevation of Lake 5.
Concern B (Figure 1) relates to questions about the groundwater gradient from Lake 5 to the
South Pond The marsh area of the South Pond was at elevation 8531-8532 in 2004, or as
much as two feet higher than the proposed final elevation of the South Pond. Is a gradient of
only 0.2 feet between Lake 5 and the South Pond sufficient to sustain that portion of
the historic groundwater supply to the South Pond?, and Will the groundwater
preference be to flow north from Lake 4 to Lake 5 instead of across the highway to the
marsh of the South Pond?, and (2) Will the wetland plants between the South Pond
and the highway dry-up?
The attached Final Planting and Seeding map, Sheet B is presumably an As-Built of
the Love Pit Wetland re-vegetation effort. It shows both emergent planting and wet meadow
seeding in the zone between the highway and the South Pond. The current and future
hydrology across that corridor should be verified before mining of Lake 5 commences and the
plan modified, if needed, to guarantee the groundwater supply to the emergent and wet
meadow plants.
Specific Request for Assistance from the Corps
These descriptions provide the basis and depth of the concern about the groundwater
supply to the Love Pit wetlands. On behalf of the Owners, the actions listed below are
requested from the Corps. The permit has apparently been closed for the Love Pit wetlands
