Whenever new control equipment is installed, or whenever a different type of control <br />equipment replaces an existing type of control equipment; or <br />d. Whenever a permit limitation must be modified; or <br />e. No later than 30 days before the existing APEN expires. <br />23. Public access must be precluded in all areas within the modeling receptor exclusion zone as <br />submitted with the modeling in the application. The exclusion zone must be fenced and posted <br />with no trespassing signs. See Attachment C for boundaries of the exclusion zone. (Reference: <br />Regulation Number 3, Part B, III.6.5) <br />24. The owner or operator must develop and submit a Nitrogen Dioxide (NO2) monitoring program <br />for approval by the Division within sixty days (60) after issuance of this permit. Monitoring <br />ambient concentrations and source impacts for NO2 must be conducted by installing one <br />monitor as per the monitoring program approved by the Division. The monitoring program must <br />address the type of instrumentation to be installed, the location of the monitor, and data <br />QA/QC requirements (see 40 CFR 58 App. B), and provide for installation of the monitoring <br />station within one hundred and eighty (180) days of the Division's approval of the monitoring <br />program. Results of such monitoring must be reported to the Division on a quarterly basis <br />within thirty (30) days of the end of the quarter. <br />The owner or operator must include a provision in the OEtM Plan for periodic review and <br />comparison of the results of such monitoring, results of on-site meteorological observations and <br />operations at the facility <br />Should the monitor record six (6) daily maximum one hour average values in a calendar year in <br />excess of 100 ppb of NO2, within 60 days of the date of the sixth such hourly average reading in <br />excess of 100 ppb, the owner or operator must submit a plan to the Division to address the <br />potential cause of such readings and propose implementation of a measure or measures <br />designed to address the issue. A monitored exceedance is not a violation of the permit or <br />applicable regulations. <br />Upon satisfactory demonstration of compliance with the one hour NO2 National Ambient Air <br />Quality Standard (NO2 standard) per 40 CFR 50.11(f) based on three (3) years of monitoring <br />data during representative operations, monitoring is no longer required and the monitor may <br />be removed. Notwithstanding any of the above, at any time the permittee may approach the <br />Division for withdrawal of this monitoring requirement. (Reference: Regulation Number 3. Part <br />A, VIII.B.) A request for withdrawal of this monitoring requirement may be based on a showing <br />that addresses factors such as, but not limited to the following: the levels of monitored NO2 <br />readings, the nature of meteorological conditions, and levels of operations at the facility <br />compared to operating levels authorized in the permit. A request for withdrawal of this <br />monitoring requirement may also be based on a modeling demonstration that predicts <br />compliance with the NO2 Standard. <br />GENERAL TERMS AND CONDITIONS: <br />25. This permit and any attachments must be retained and made available for inspection upon <br />request. The permit may be reissued to a new owner by the Division as provided in Regulation <br />Number 3, Part B, ILB upon a request for transfer of ownership and the submittal of a revised <br />APEN and the required fee. <br />&®COLORADO <br />Air Pollution Control Division <br />Page 10 of 17 <br />
