Deep Cut LLC- 22 West Pit Page 2 <br /> Adequacy response 02 Permit # M-2017-032 <br /> Despite what the mining plan map shows for Option 1, the Applicant is proposing to be <br /> bonded for what is shown on the Exhibit L map, which shows no more than 14.47 acres <br /> of groundwater to be exposed, with the two pre-law areas to remain undisturbed. <br /> Therefore, please acknowledge that prior to disturbing additional land or exposing <br /> additional groundwater than what is shown on the Exhibit L map, the Applicant will be <br /> required to submit a Technical Revision to revise the Exhibit L map and cost estimate <br /> accordingly. <br /> No, what we are proposing it that Reclamation will run concurrent with mining so there is <br /> no more reclamation needed at any one time then what is shown on the Exhibit L Map and <br /> in the Exhibit L text. <br /> All of the land was been disturbed in the past and as mining progresses into the old Plant <br /> Site Area that the only reclamation needed will be bank sloping and grading along the new <br /> lake shores and grading where material is being stockpiled and processed. If Deep Cut is <br /> required to file a Technical Revision and bond increase every time the lake increases it <br /> would be unreasonable and defeats the maximum disturbance limits doctrine followed in <br /> the past. The Temporary Substitute Supply Plan (SWSP) is renewed yearly and the <br /> estimated future lake has to be address in that document. <br /> Exhibit L was prepared to address the worst case scenario that the operator would create <br /> as mining progresses thru the old plant site area knowing that as more lake surface is <br /> exposed Deep Cut will be revising their SWSP to provide makeup water. This is how <br /> normal mining operations operate. Deep Cut will commit to limiting the length of the <br /> ,working face to 350 feet and having no more then 0.50 acres needing grading, resoiling <br /> and seeding and 12.33 acres of industrial area needing grading. The SWSP for the next 2 <br /> years covers 15.0 acres total exposed water surface. Deep Cut LLC will submit a Technical <br /> Revision to revise the Exhibit L Map and Reclamation Cost Estimate prior to disturbing <br /> additional land in the eastern pre-law area and supply the Division a copies of the SWSP <br /> filed with the Division of Water Resources each time the SWSP is renewed or amended to <br /> increase the amount of ground water that will be exposed,other than what is shown on <br /> the Exhibit L Map or the lake exceeds 15.0 acres <br /> 2) Looking at the mining plan map and Exhibit L map submitted, it appears the maximum <br /> disturbed area for Option 1 would be 27.75 acres [38.35 acres (permit area)—9.03 acres <br /> (NE pre-law area)— 1.57 acres (NW pre-law area)]. Is this correct? If not, please specify <br /> the maximum disturbed area for Option 1, including ponds, mined areas, <br /> stockpiling/storage areas, and roads. for Option 2, it appears the entire permit area of <br /> 38.35 acres would be considered the maximum disturbed area. Is this correct? If not, <br /> please specify the maximum disturbed area for Option 2, including ponds, mined areas, <br /> stockpiling/storage areas, and roads. <br />
