VI. Use of Explosives — Rule 4.08
The explosives area at the Foidel Creek Mine was transferred from Mine No. 1, Mine
No. 2, and Eckman Park Mine, Permit No. C-81-071. Surface blasting is limited to 5
pounds of explosives. No specific approvals are granted to the applicant under this
section.

VIII. Coal Mine Waste Banks — Rule 4.10
Technical Revision No. 21 (TR -21) approved a coal waste pile south of Pond D at the
main facility area of the Foidel Creek mine. The coal waste pile configuration is a
side -hill design with a maximum estimated volume of 3 million cubic yards of coal
mine waste. The source of the waste is two wash plants which process any low quality
coal product produced by mining, or low quality coal not processed. The Division
approves the design and any alternative specifications as represented in Exhibit 26A of
the PAP (4.10.1(1)).
An expansion to the coal mine waste pile was approved with Technical Revision No.
67 (TR -67). The waste pile expansion provides for approximately 20.0 million cubic
yards of additional refuse placement capacity of the waste pile. The following
stipulation was attached with TR -67 and is complied with as a result of this Permit
Renewal (RN -06):
Stipulation No. 64: was attached to the permit through TR -67, approved on November
13, 2009. Twentymile Coal is approved to construct the Refuse Disposal Area
Expansion in accordance with designs approved in Technical Revision No. 67.
Twentymile Coal Company requested to provide bond for the increased disturbance
area in three increments. The first increment, "Initial Bonded Disturbance" of 50.0
acres, is limited to construction of 30.3 acres of refuse pile expansion, 2.4 acres of haul
road corridor, 5.9 acres of unclassified stockpile, 3.5 acres of topsoil stockpile, .04
acres of stockpile haul corridors, and 7.5 acres of construction of RDA 10 and RDA 11
ditches, as shown on Map C-102 (11/13/2009). Prior to disturbance of the Refuse
Disposal Disturbance, Twentymile Coal is required to submit additional bond adequate
for disturbances associated with bonding increments I and II. No disturbance
associated with bonding increments I and II shall occur prior to submittal and Division
approval of additional bond.
The current progress of the RDA Expansion does not extend beyond the originally
delineated Phase I area. TC will begin the extension of the underdrain and construct
additional temporary perimeter collection ditches in conjunction with the initiation of
Phase II of the RDA Expansion. Phase II will involve an additional 30 acres of
disturbance for the Phase II footprint and soil removal buffer zone. All bonding costs
