ponds and treatment facilities are not necessary for the drainage to meet the <br />effluent limitations of Rule 4.05.2 and applicable State and Federal water <br />quality standards for receiving streams and also due to the fact that no mixing <br />of surface drainage with a discharge from underground workings will occur. <br />Discussions of the approved alternate sediment control locations are located <br />on pages 2.05-82 through 2.05-84.7 in the permit application. No new <br />alternative sediment control areas are proposed or approved with this permit <br />renewal. <br />B. Surface and Ground Water Monitoring <br />The applicant will conduct monitoring of ground water in a manner approved <br />by the Division. The ground water monitoring plan can be found in Exhibit <br />14, Volume II -B of the permit application (4.05.13(1)). <br />2. The applicant will conduct monitoring of surface water in a manner approved <br />by the Division. The monitoring plan was submitted under 2.05.6(3)(b)(iv) <br />and can be found in Exhibit 14, Volume II -B of the permit application <br />(4.05.13(2)). NPDES monitoring is conducted under permits CO -0027154 <br />(surface facilities area), CO -0042161 (Fish Creek Borehole), CO -0036684 <br />(Fish Creek Tipple), COG -850051 (18RT), COG-00850054(6MN sediment <br />pond). <br />3. The following wells serve as the Foidel Creek Mine's ground water points of <br />compliance: 97013TM (Twentymile Sandstone), 008-77-58 (Wadge <br />overburden), 008-AU3 (Fish Creek alluvium), 008 -AT -1 (Trout Creek <br />alluvium), and 008 -AV -2 (Foidel Creek alluvium.) <br />The Division has reviewed the surface and ground water monitoring plans as part <br />of the renewal process. These monitoring plans are adequate to monitor for the <br />development of impacts, if any should develop (4.05.13(2)). <br />IV. Topsoil — Rule 4.06 <br />Replaced soils that were stockpiled will be chisel plowed in addition to contour <br />furrowed. These soils will be drill seeded as soon as practicable following topsoil <br />replacement. Stockpiled topsoil not utilized at Energy Mine No. 3 has been <br />transferred to the Foidel Creek permit for distribution at the Fish Creek Tipple. <br />An alternative treatment to eliminate slippage surfaces, relieve compaction, and <br />provide for root penetration is approved. This treatment will consist of chisel plowing <br />(4.06.4(1)). <br />V. Sealing of Drilled Holes and Underground Openings — Rule 4.07 <br />The Division will require that each hole, well or other underground opening be <br />capped, sealed, backfilled, or otherwise properly managed (4.07.3). <br />Foidel Creek Mine 29 August 10, 2018 <br />
