haul roads. Appendix 2.05.3(3)-3 contains the as -built for the West Haul Road (Section 0+00 to <br />10+52). A portion of the West Haul Road is located within 100 feet of the Montrose County road <br />right-of-way. As required by DRMS Regulations, NHN requested Montrose County for a waiver <br />to disturb within 100 feet of the County right-of-way. Montrose County has given such a waiver <br />limiting the disturbance to within 25 feet of rights-of-way as a part of the Special Use Permit. <br />Any roads constructed within the mining blocks shown on Map 2.05.3(3)-3 will be considered <br />in -pit haulage roads and are not required to meet the requirements of Rule 4.03.1. <br />General Requirements: NHN will ensure that construction, maintenance, and postmining <br />conditions of haul roads will control or prevent erosion and siltation, pollution of air or water, <br />and damage to public or private property. The design and construction of haul roads not within <br />the disturbed area in accordance with 4.05.2(4) will be certified by a qualified registered <br />professional engineer. The certification report will be submitted to the Division upon completion <br />of any construction and will indicate that the road has been constructed as designed and in <br />accordance with the approved plan. All haul roads will be removed and the land affected <br />reclaimed in accordance with the requirements of 4.03.1(7) unless retention of the road is <br />approved as part of the approved postmining land use and the landowner requests to the Division <br />in writing, that the road or certain parts thereof are to be left open for further use. <br />Design and Construction: Haul roads not within the disturbed area in accordance with 4.05.2(4) <br />will be designed and constructed in compliance with the following standards in order to control <br />erosion and disturbance of the hydrologic balance. Maximum road grades will be as follows: The <br />overall grade will not be steeper than l Oh: l v (10 percent). Maximum pitch grade will not be <br />steeper than 6.5h:1v (15 percent). There will not be more than 300 feet of pitch grade exceeding <br />10 percent within any consecutive 1,000 feet, but in no case will there be any pitch grade steeper <br />than 6.5h:ly (15 percent). Haul roads will have a horizontal alignment as consistent with the <br />existing topography as possible and will provide the alignment required to meet the performance <br />standards of 4.03.1. Horizontal and vertical alignment will be coordinated to ensure that the road <br />will not cause environmental damage. Road widths will be appropriate for the anticipated <br />volume of traffic and the nature and speed of vehicles to be used. Cut slopes will not be steeper <br />than 1.5h: Iv in unconsolidated materials or 0.25h: Iv in rock, except that steeper slopes may be <br />specifically authorized by the Division if geotechnical analysis demonstrates that a minimum <br />safety factor of 1.5 can be maintained or if geotechnical analysis demonstrates that a safety factor <br />less than 1.5 will not result in significant environmental harm or harm to the public health and <br />safety. Temporary erosion control measures will be implemented during construction to <br />minimize sedimentation and erosion until permanent control measures can be established. <br />All vegetation material and topsoil will be removed from the embankment foundation during <br />construction to increase stability and no vegetation material or topsoil will be placed beneath or <br />in any haul road embankment.
