Mike Peacock of Mountain Coal Company (MCC) accompanied the inspection. The weather was hot
and dry, with wildfire smoke haze in the air. The mine was active.

AIR RESOURCE PROTECTION – Rule 4.17:
The Run Of Mine coal stockpile was observed during a good breeze. No dust was visible rising from the
surface of the pile.
Water trucks were operating throughout the inspection.

HYDROLOGIC BALANCE - Rule 4.05
Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10;
Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13;
Drainage – Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18:
Water levels were low in all ponds, following a very dry period. No problems were observed with any of
the ponds.
The concrete-lined ditch adjacent to the Run-of-Mine coal stockpile was cracked and had heaved in
places. MCC’s mine site-wide ditch repair project was underway along the portal access road and MCC said that
they plan to complete repairs to the stockpile ditch next. This is not a compliance issue for the Division since the
ditch will still convey surface runoff to the sediment pond.

GENERAL MINE PLAN COMPLIANCE:
At the time of the inspection the longwall was in panel E7, at around cross cut 19 on the head gate.
Continuous miners were in the Sunset Mains South, at around cross cut 8; and in the E8 head gate, at around cross
cut 23.
The following permitting actions were in progress:
