The seepage was observed again during this
inspection. The seepage was not observed to be at high enough of a rate to affect the stability of the embankment.
A close eye will be kept on the embankment to ensure that it does not become unstable. If the embankment were
to fail, the sec ond cell in the system would capture the water. The other embankments in the system were stable
and had no indications of erosion. All of the spillways in the system were in good repair and functioning as
designed.

The SDH 3/5 D seam dewatering system was active. Only the lowest of the 3 cells was being used to impound
water. The water level in the cell had reached the level of the primary discharge outlet and was discharging into
the wash leading to Red Wash. The embankment of the cell was stable w ith no erosional concerns. The
embankment has star ted to become well vegetated.

The Raw Water Lagoon was holding water during the inspection. The embankments were very well vegetated and
stable. There were no indications of erosion.

PROCESSING WAST E/COAL MINE WASTE PILES – Rule 4.10 and 4.11
Drainage Control; Surface Stabilization; Placement:
There are 2 active refuse piles at the Deserado Mine, the RP -2/3/4 and RP-5a piles.
