AGGREGATE <br /> Mr.Jared Ebert,Division of Reclamation,Mining and Safety INDUSTRIES <br /> July 16,2018 <br /> are also being provided to additional Thornton representatives, listed as"cc's"below, and they may be <br /> contacted at their referenced e-mail addresses. <br /> Remaining Permit Boundary and Reclamation <br /> On August 13, 2013,the Division approved TR-05 with regard to the remaining 54+/-acre <br /> parcel of Permit M-1977-436 ("North Lake"area),which is still owned by Al and will remain in <br /> the reclamation plan as the new permit boundary. This parcel of land is depicted on the enclosed <br /> Remaining Mining and Reclamation Boundary Map. <br /> Reclamation within the remaining permit boundary will be in accordance with TR-05, which <br /> approved additional backfilling and grading to reduce groundwater exposure to 0.5 acre or less. <br /> To date, on-site materials have been used to backfill the pond area to reduce groundwater <br /> exposure to approximately 5.0 acres, the evaporative losses of which are covered under a <br /> Division of Water Resources approved Temporary Substitute Water Supply Plan. Additional on- <br /> site material and import material will be used to backfill remaining exposed groundwater. The <br /> appropriate notice for any import of inert fill will be filed with the Division. With the exception <br /> of existing roadways to remain for access, final grading and topsoiling of this parcel will be <br /> completed. Seeding will be in accordance with the native grass seed mix set forth in TR-05. <br /> In the Division's report of its June 2, 2015 inspection, it was noted that a spillway in the <br /> northeast corner of the "North Lake"area had not been constructed. While Permit AM-2 <br /> provided for possible construction of a spillway at the north end of the "North Lake", Urban <br /> Drainage and Flood Control District did not want that hard surface feature. In order to assure <br /> that this feature was no longer considered as a requirement of reclamation, Al amended its TR- <br /> 05 revision request to address this matter in its August 12, 2013 response to the Division's <br /> adequacy review of TR-05. <br /> Al is not seeking a reduction of the current financial warranty of$150,000 and believes that it is sufficient <br /> to address remaining reclamation responsibility. Al therefore respectfully requests Division approval of <br /> the requested acreage reduction(release)from Permit No. M-1977-436 <br /> Very truly yours, <br /> Connie N.
