The operation is not expected to intercept the regional ground water table or impact ground
water as discussed above.
(c) Compliance with applicable federal and Colorado dredge and fill requirements:
This requirement is not applicable since no wetlands will be impacted.
(d) Remove temporary or large siltation structures from drainage ways after disturbed
area are revegetated and stabilized, if required by the Reclamation Plan:
No detention ponds or livestock watering pond will be constructed on the floor of the operation.
(2) Earthen dams, if necessary to impound water, may be constructed if the formation
of such impoundments will not damage adjoining property or conflict with water pollution
laws, rules or regulations of the federal government, the State of Colorado or with any local
government pollution ordinances:
Please see 3.1.6(1)(d) above.
(3) All surface areas of the affected land, including spoil piles shall be stabilized and
protected so as to effectively control erosion:
All surface areas of the affected land will be stabilized and protected so as to effectively control
erosion. The Operator does not plan on having any spoil piles. The proposed excess overburden
pile will be located on the floor of the Phase 1. The pit floor will be sloped at a 1.5% grade
toward the nearest downgradient drainage which will help prevent erosion and control runoff,
allowing precipitation to infiltrate into the pit floor. In addition, the toe of stockpiles will be
surrounded with runoff control material, such as straw bales or other suitable material, provided
the erosion control measure does not interfere with mining or reclamation operations.
3.1.7 Ground Water—Specific Requirements:
Ground water is discussed in Exhibit"G".
3.1.8 Wildlife:
(1) All aspects of the mining and reclamation plan shall take into account the safety
and protection of wildlife on the mine site, and all associated facilities with special attention
given to critical periods for wildlife:
Wildlife use during active mining is not anticipated. Regardless, the Operator will consider the
safety and protection of any wildlife entering the site during mining and reclamation operations.
Finally, no described critical periods or species of concern are known by
Applicant/Operator/Landowner.
32
