Elk Creek Mine (C-1981-022) MT- 7 <br />decision to approve MR -109 was proposed and issued on 30 May. <br />Section III - Status of Stipulations <br />The stipulation history for the Elk Creek Mine was reviewed as part of the midterm review. The review <br />included an investigation of any stipulations imposed since the last permit renewal, and any responses <br />to existing stipulations received since the last permit renewal. Any stipulations associated with this <br />permit and issued over the life of this operation which are not discussed in this midterm review have <br />been complied with or terminated. <br />Section IV — Permit Variances and Specific Approvals <br />Variances from Approximate Original Contour (AOC) and Stream Buffer Zone rules were discussed in <br />some detail in Section I. The variances are still appropriate, and the operator is in compliance with the <br />terms of approval. <br />Section V - Enforcement Actions <br />CV -2014-008 was issued on 28 October 2014 for failure to provide well abandonment reports within <br />30 -days; failure to provide accurate information in well abandonment reports; failure to cut well casing <br />below surface; failure to plug and/or seal well casing to within three feet of the ground surface; failure <br />to temporarily cap and/or seal wells that will be used in the future as required; failure to construct drill <br />pads as permitted; failure to construct drill pads in location(s) shown on map; failure to construct light - <br />use roads as permitted; failure to construct light -use roads in location(s) shown on map; failure to <br />comply with all permit conditions; and failure to provide proper liability for drill pads and light -use <br />roads. <br />Minor Revision no. 106 (MR -106) was submitted to the Division on 27 January 2015, and found <br />complete on 6 February. MR -106 updated the gob vent borehole information and well abandonment <br />reports in the Permit Application Packet (PAP), in order to abate CV -2014-008. The decision due date <br />for MR -106 was extended twice before a decision to approve it was proposed and issued on 30 June. <br />Page 12 of 14 <br />
