Corrective Action C. specified the following: <br /> Within 60 days of the effective date of the Board's order, the Operator shall submit a <br /> Technical Revision (with notice to Fred Orr) or an Amendment to the permit to revise the <br /> Permanent Plan for the Orr property to ensure mitigation measures for the Orr property will <br /> function year round with little maintenance. Approval of such revision shall bew required <br /> within the statutory time frames. Implementation of the revised Permanent Plan shall be <br /> required within thirty (30) days of approval. During the interim, the Operator shall be required <br /> to keep the Orr property sufficiently drained. <br /> Aggregate Industries will keep the "Orr Drain" open 365 days per year effective February 16, <br /> 2018. As noted in Tetra Tech's letter report and monitoring data, submitted to the Division <br /> June 30, 2018, water levels have declined. Keeping the Orr Drain open year-round is <br /> expected to be sufficient to ensure mitigation for the Orr property on a permanent basis. <br /> At your earliest convenience, Aggregate Industries requests that the Division conduct an <br /> inspection of the Orr property and the Orr Drain to witness the progress that has been made <br /> in addressing this issue. <br /> If you have any questions or require additional information regarding this technical revision <br /> Delivering Value A member of the Holcim Group <br />
