Work will progress using a small to medium-sized excavator with or without blade (for example <br />a HYUNDAI Model: HX145LCRD was used in 2017). If promising pegmatites are encountered in <br />limited cross -cut trenching, the area to be trenched will be worked generally from one lower <br />side, across the planned area by first clearing topsoil and placing it above the area of the cut, <br />then trenching across the slope cutting a small bench. Once sufficient area has been trenched, <br />continued trenching will back fill the original space trenched so that the work will proceed as a <br />cut and fill operation, cutting in front and filling behind. In this way, large dumps will be <br />avoided and reclamation efforts will be reduced as the backfill, though rough, will be already <br />replaced into the trenched area. Final recontouring, raking and seeding will be all that would <br />remain after backfill from this type of excavation. <br />Excavation, with concurrent backfilling, will take place first, and when work is completed in a <br />given locality, reclamation work (consisting of re -contouring, raking, and placement of felled <br />trees and boulders), will be conducted prior to moving to the next locality. Seeding would be <br />conducted during the fall as recommended by USFS. <br />Area and volume -wise, a maximum of 2.0 acres of topsoil replacement/final recontour work <br />and seeding as well as up to 1,000 yards of backfill work would be necessary at the close of <br />each area or season. <br />Final reclamation of all sites is planned to be complete by the fall of 2024. <br />6.3.3 (1) (a) <br />The schedule and location for the start of excavation at the Ten Percenter is tentative. Our <br />work may start at locale 4.10 Upper Area, as listed in 6.3.1 (3) Exhibit A, Table 1, and depicted <br />in 6.3.5 Exhibit E — 4, Supplemental Map. Initial excavation is planned to begin as early as May <br />though more likely in late July or early August 2019, depending on the status of permitting, <br />weather, ground conditions, and availability of equipment. Excavation will continue <br />intermittently (generally 4 weeks or less per year) for the life of the Plan of Operations (USFS <br />MPO-2018-004), generally during late summer or early fall months from 2019 through 2024. <br />Section 34-32-103(6)(a)(II), C.R.S. in part, states; "The requirement of a notice of temporary <br />cessation shall not apply to operators who resume operating within one year and have included, <br />in their permit applications, a statement that the affected lands are to be used for less than one <br />hundred eighty days per year."
