As of the date of the submission of this application the CDPHE Water Quality Control Division <br /> had not responded. <br /> 4. CDPHE Air Pollution Control Division. <br /> An e-mail requesting information concerning air quality permitting requirements from the <br /> Colorado Department of Public Health & Environment Air Pollution Control Division was sent to <br /> the CDPHE website cdphe.commentsapcd@state.co.us on June 13,2018. <br /> A response was received from the CDPHE (Christine Hoefler—see attached e-mail string)which <br /> provided a link to threshold limits that would require reporting/permitting with the CDPHE.A <br /> review of those threshold limits has found that reporting/permitting concerning air emissions <br /> will not be required. <br /> 5. US Bureau of Land Management. <br /> The existing mining claim is filed with the US Bureau of Land Management (El Rancho Bondo <br /> CMC-278502). <br /> The BLM has required that a Plan of Operation be submitted, approved,and followed (due to <br /> the location of the claim in the Royal Gorge Area).The original approved Plan of Operation <br /> dated June 27, 2012 and a Modified Plan of Operation also approved by the BLM (dated <br /> 7/30/2015) are attached to this Exhibit. <br /> 6. US Army Corp of Engineers. <br /> Since there is no dredging on the site there should be no dredge and fill (404) permit required. <br /> Subsequently the US Army Corp of Engineers was not contacted to review the mining operation. <br /> 7. The Fremont County Planning Department. <br /> The Fremont County Planning and Zoning Department was contacted by phone on 6/14/2018 <br /> and discussed with Ernie Martinez (Land Use Technician).Subsequently a message was to be <br /> relayed to Matt Koch (Planning Director)for further discussion.An e-mail was also sent to Matt <br /> Koch on June 14, 2018 (see attached copy). <br /> As of the date of the submission of this application the county Planning and Zoning Department <br /> has not responded. <br /> Please note that although several of the above agencies have not vet responded,the applicant is <br /> aware that this does not relieve the applicant from having to follow any subsequent legal <br /> requirements that may be forthcoming from these agencies after submission of this application. <br />
