(g) There will be no new roads or other improvements to the existing ATV trail other than normal <br /> maintenance. <br /> (h) Water for washing gravels is presently taken from the Arkansas River.Some sluicing and panning <br /> is done directly in the River and high banking is also performed using a pump to transfer water <br /> under pressure to a sluice located 20 o 50 feet up the bank from the river's edge.The pump <br /> used for this operation is less than 8 horsepower with a 2" diameter or less discharge and is <br /> estimated to deliver less than 150 gallons per minute of flow.Water used in high banking is <br /> discharged into a retention pond to settle out solids before it returns to the river. <br /> (i) Presently groundwater has not been encountered at the site, however high river levels do <br /> appear to infiltrate into the deepest part of the excavation.The mining being performed should <br /> not affect the quality of the water as it is used only for washing gravels and all discharges are <br /> directed to a retention pond before re-entering the river. <br /> (j) There should be no injury to existing water rights as water is not being"consumed" in the <br /> mining operation but only being used for washing of gravels and then being returned to the <br /> river.The Colorado Division of Water Resources has also been contacted to review any concerns <br /> with the administration of water rights with respect to this operation. <br /> (k) It is not expected that any toxic or acid producing materials will be encountered in the course of <br /> excavation and washing of gravels in the search for placer gold on the banks of the Arkansas <br /> River. <br /> (1) It is not expected that there will be any impact on the"hydrologic balance" or"off site damage", <br /> and it is intended that the reclaimed areas will be consistent with proposed future land use (see <br /> also permit requirements"Compliance With Other Laws" contact with County Planning <br /> Department noted in Exhibit F. <br /> (m)The placer mining gravels will be processed (washed) onsite by panning,sluicing, and/or high <br /> banking. <br /> (n) The primary mineral to be developed is native gold in the form of nuggets, pickers,and flakes. <br /> There are no secondary or incidental commodities to be mined or extracted. <br /> (o) There will be no explosives used in this mining operation or any reclamation activities. <br /> There are no tailings ponds associated with this operation and subsequently section 6.3.3 (2)will <br /> not be addressed. <br /> Please also reference the Plan of Operation approved by the BLM and attached to Exhibit F. <br />
