(Client) contracted Atwell, LLC (Atwell) to conduct a Phase I Breeding Avian <br /> Consern Species Risk Assessment for the proposed Granby RV Resort(hereafter collectively referred <br /> to as the Project Area). The Project is located within the Town of Granby, Grand County, Colorado <br /> on three primary land parcels (hereafter collectively referred to as the "Project Area") located <br /> northeast of the intersection of U.S. Highway 34 and U.S. Highway 40. <br /> The purpose of this technical data summary outlined below is to provide an assessment of sensitive <br /> and/or conservation concern avian species that may breed within the Project Area and be <br /> vulnerable to habitat clearing procedures required for on-site development. The Migratory Bird <br /> Treaty Act(META 1918) makes it illegal for anyone to "take"any migratory bird,or the parts, nests, <br /> or eggs of migratory bird species. The MBTA protects 1,006 species of birds, including waterfowl, <br /> shorebirds, songbirds, raptors, wading birds, and seabirds. The MBTA regulates direct take or nest <br /> destruction of avian species. <br /> As there currently is no permitting process to protect a project developer from prosecution for <br /> incidental take under the MBTA, it can be beneficial to delevopers to identify nesting habitat <br /> resources during pre-development/construction phases in order to prevent potentially harmful <br /> habitat disturbances to the greatest extent practicable.
