(4) The Operator/Applicant shall indicate the projected amount from <br /> each of the sources of water to supply the project water <br /> requirements for the mining operation and reclamation. <br /> Reclamation water will originate from the Bunte Highline Ditch, or <br /> Shorefox Diversion Nos. 4 or 5 on the Colorado River. Each of <br /> those sources has sufficient water to meet the entire reclamation <br /> demand. Refer to Colorado Water Court Case No. 03CW333. <br /> (5) The Operator/Applicant shall affirmatively state that the <br /> Operator/Applicant has acquired (or has applied for) a National <br /> Pollutant Discharge Elimination System (NPDES) permit from the <br /> Water Quality Control Division at the Colorado Department of <br /> Health, if necessary. <br /> The Town of Granby affirms that a CDPHE NPDES will be in place <br /> prior to any regulated activity on River Run Ranch or other <br /> development with the permit area. <br /> 6.4.8 EXHIBIT H-Wildlifclnformation <br /> (1) In developing the wildlife information,the Operator/Applicant may <br /> wish to contact the local wildlife conservation officer. The <br /> Operator/Applicant shall include in this Exhibit,a description of the <br /> game and non-game resources on and in the vicinity of the <br /> application area,including: <br /> (a) a description of the significant wildlife resources on the <br /> affected land; <br /> Atwell completed a Technical Data Summary <br /> Memorandum for the Sun Communities RV Resort—Phase <br /> 1 Breeding Avian Concern Species Risk Assessment(May <br /> 10, 2017). The memo provides general findings and <br /> conclusions that are summarized here but can be found in <br /> Appendix B. <br /> • Three species of nesting birds may utilize the area: <br /> o Swainson's Hawk <br /> o Greater Sage Grouse <br /> o Willow flycatcher <br /> • Federally threatened Yellow-billed Cuckoo likely does <br /> not next within the project area. The area is outside of <br /> critical habitat. <br /> • Greater sage grouse may utilize the sagebrush <br /> shrubland in the recreation open space on Exhibit D. <br /> • Willow flycatcher may be present in the wetland areas <br /> in the project area.
