EXHIBIT M <br /> OTHER PERMITS AND LICENSES REQUIRED <br /> 1 . An Air Pollution permit will be applied for prior to commencement <br /> of operations if more then 70, 000 tons will be mined in any given <br /> year. <br /> 2 . A Use by Special Review permit from Otero County was approved on <br /> June 15, 1977 . <br /> 3 . This is a open pit operation and ground water will be exposed so a <br /> well permit and temporary supply plan is necessary. The operator <br /> will obtain final augmentation for all of the post 1981 water on <br /> the site before asking for final release. There are no pre 1981 <br /> water features on the permit area and at this time 12 . 68 acres of <br /> post 1981 which is cover by a Substitute Water Supply Plan (SWSP) <br /> and well permit number 52017-F. <br /> 4 . A dredge fill permit (404) will be acquired if waters of the U.S. <br /> will be impacted. None is needed at this time. <br /> 5 . A Colorado Department of Health and Environment Colorado Pollution <br /> Discharge permit (NPDES) will be obtained, if needed, prior to <br /> discharging process water from the mine. <br /> 6 . A Storm Water Management Plan (SWMP) will be prepared for this pit <br /> if a Colorado Discharge permit is needed. <br /> 64 (revised 4/30/2018) <br />
