EXHIBIT H <br /> WILDLIFE STATEMENT. <br /> On March 24th, 2016 we mailed a request for information regarding <br /> a Wildlife Statement from the Southeast region of the Colorado <br /> Division of Parks and Wildlife . As of the application submittal <br /> date no response has been received from them. <br /> A Wildlife statement was issued for the existing permit in 1977 <br /> and said there were no known endangered or threatened species on <br /> the area and that the net impact would have a positive impact on <br /> wildlife . Wildlife resources on the affected lands are limited to <br /> the existing ground cover consisting of seasonal grasses, trees <br /> and weeds . Ground cover in this area averages approximately 25%, <br /> with some areas having little or no cover, only exposed gravel . <br /> Use of the area by wildlife is minimal , as the area is mostly <br /> disturbed. The site has been operated as an active gravel mine <br /> since 1965 and past landowners have operated a ready-mix opera- <br /> tion on the western section for much of this time so there is <br /> little wildlife habitat on the mine . The lake is used by water <br /> fowl and probably has fish in it . Wildlife expected to be found <br /> on the property may include deer, small rodents, mammals, water <br /> fowl, fish and song birds . There are no known threatened or <br /> endangered species on the property. <br /> Existing wildlife in the area is not expected to be significantly <br /> impacted by mining this site . Temporary and permanent losses of <br /> food and habitat is not expected to be significant as the area <br /> currently has limited potential for wildlife food and habitat . <br /> Prior to opening new area for mining, Deep Cut will make observa- <br /> tions of the new area to determine if there are Raptors using the <br /> site as active hunting areas, over night roost sites or nesting <br /> sites . If any are observed, the Lamar Office of the Colorado <br /> Parks and Wildlife (CPW) office will be contacted to confirm the <br /> observations and advise Deep Cut on what actions should be taken <br /> to avoid disrupting the sites during nesting times . Deep Cut <br /> will then take the appropriate actions to prevent disturbance to <br /> the nest or roost site . If Raptor used occurs or is observed <br /> after mining activities have commenced on an area then CPW will <br /> be contacted to advise actions that can be worked out to operate <br /> the mine without completely abandoning the site for long periods <br /> of time . <br /> 24 (revised 4/30/2018) <br />
