EXHIBIT D <br /> MINING PLAN AND TIMETABLE <br /> LOCATION <br /> The property is located in Otero County approximately two miles <br /> east of Rocky Ford, Colorado . It is located on the western part <br /> of an existing mine known as the Rocky Ford East Pit operated by <br /> Valco, Inc . under Permit Number M-1977-560 . Surrounded uses <br /> include agriculture, commercial/industrial and mining. It lies <br /> north of State Highway 50 and south of the Arkansas River. <br /> Please refer to EXHIBITB -VICINITY MAP for the property configuration <br /> and the relationship to surrounding geological features . <br /> HISTORY <br /> Excavation began in the western most portion of the property in <br /> 1962 and continued in an easterly direction through 1968 . This <br /> area is labeled Plant Site on the western side of the property <br /> and is zoned industrial . This industrial area was used as a <br /> concrete batch plant site, mixer parking and material storage <br /> area associated with Valco ' s ready mix business . No topsoil or <br /> overburden was salvaged from the PLANTSITE area when it was first <br /> mined. It is mostly covered by sand, gravel and old concrete <br /> washout areas generated by the concrete business that operate at <br /> the site . In 1969 the direction of mining was modified and <br /> mining began at the eastern most edge of the property and the <br /> property was mined from east to west . The area that is currently <br /> lake or stockpile area was part of a melon farm at the time and <br /> so intensive agriculture practices were taking place that left <br /> little native vegetation on the area . The large stockpiles of <br /> topsoil/overburden on the north east side of the lake came for <br /> material stripped of the mining area prior to permitting in 1977 <br /> and is therefore pre-law disturbed area . <br /> CURRENT CONDITIONS <br /> The permit area covers 38 . 35 acre ± with a site elevation of <br /> approximately 4130 feet, sea level datum. This area has 2 <br /> distinct land types that have been developed over the years . The <br /> eastern active, mine area and the old industrial (western) area . <br /> The western portion, that includes an old batch plant site, is <br /> covered with various items left when the batch plant was removed. <br /> Much of the area is graveled parking area, concrete slabs, area <br /> cover with naturally invading trees, material stockpiles and <br /> concrete washout pads . The south slope of the old batch plant <br /> area was left out of the permit as it was disturbed prior to 1970 <br /> 5 <br />
