Box 628 <br />Nucla, CO 81424 <br />Dear Mr. Wolney, <br />Per our discussion in regards to retaining the New Horizon haul road as a permanent feature In <br />accordance with Rule 1.04(71), this letter is to serve as formal notification that as the surface <br />landowner, I would like the haul road and topsoil stockpile site to remain as a permanent feature on my <br />property. <br />Rule 1.04(71) states, "...All of the land uses defined below may include land used for support facilities <br />which are adjacent to, or are an integral part of the land..." Retention of the haul road and topsoil <br />stockpile site on my property will be utilized as a support facility directly adjacent to long term <br />reclamation areas so that my land can be property accessed by using the haul road, and the topsoil pile <br />site will be used to store agriculture related equipment and supplies.
