9. On September 29, 2017, the Division received a written complaint from <br />Fred Orr asserting that Operator had not completed the mitigation plan in a timely <br />fashion and that groundwater elevations had not significantly changed. <br />10. The Division conducted an inspection of the Hazeltine Mine and <br />observed the Complainant Property on November 8, 2017. Mike Refer and Connie <br />Davis attended the inspection on behalf of the Operator. During the inspection, the <br />Division found that the Orr property was still flooded, the Orr Drain was closed, <br />and groundwater mounding mitigation measures were not being implemented. The <br />Division also found that the water monitoring data required for the site was <br />incomplete or missing for the 2017 monitoring year. These two issues were cited as <br />problems in the inspection report. The inspection report was signed on December <br />22, 2017. <br />11. As part of the inspection report, the Division imposed corrective <br />actions on Operator, including: <br />a. Operator must submit the incomplete or missing results of the water <br />monitoring for the 2017 monitoring year by December 29, 2017; <br />b. Operator must take immediate action to sufficiently dry the surface of <br />the Orr property, and submit a Technical Revision to the Permanent <br />Plan so the mitigation measures to be taken for the Orr property will <br />function year round with little maintenance by January 31, 2018. <br />12. On January 9, 2018, the Operator responded to the Division's <br />corrective action regarding missing or incomplete water monitoring results, stating <br />that no additional data was available. The Operator indicated that monitoring well <br />HZMW-2 was inaccessible and that gauge SG -2 was removed to accommodate <br />construction of the Orr Drain after December 12, 2016 and was reinstalled for <br />continued monitoring that resumed in August 2017. <br />13. The Division conducted a follow-up inspection on February 1, 2018. <br />Connie Davis was present on behalf of the Operator. The inspection report was <br />signed on February 16, 2018. During that inspection, the Division determined that <br />the Orr property was still flooded and groundwater mounding mitigation measures <br />were not being implemented. The Division cited possible violations for failure to <br />submit the required water monitoring report data, failure to comply with the <br />condition of a reclamation permit, failure to mitigate the disturbance to the <br />prevailing hydrologic balance in the surrounding area, failure to protect areas <br />outside of the affected land from damage, and for failure to comply with the <br />conditions of an order. <br />Aggregate Industries - WCR, Inc. <br />M-2004-031 <br />MV -2015-003 and MV -2018-008 <br />3 <br />
