The Fish and Wildlife Plan beginning on Page 2.05-35.2 of the permit does not fully address the <br />items required under Rule 2.05.6(2). A number of fish and wildlife species are identified to exist <br />and/or occur within the permit and affected area. Please update the Fish and Wildlife Plan to <br />discuss how future mining, reclamation and site maintenance operations will minimize <br />disturbances and adverse impacts to fish and wildlife species. Please review Rule 4.18(5) to help <br />formulate a wildlife protection plan. <br />10. According to the fish and wildlife plan, no rare or endangered species were observed within the <br />permit area during the collection of baseline wildlife resource information. However, the <br />potential exists for threatened and endangered species to be exist and/or occur within the permit <br />and affected area. Section 2.04.11 of the permit discusses the species that may exist within the <br />permit area. The fish and wildlife plan discusses the protection of raptors and the procedure that <br />will be followed should threatened and endangered species be observed at the site. However, <br />the plan does not discuss potential impact control measures and management techniques that <br />will be utilized for future mining, reclamation and site maintenance operations to protect the <br />threatened and endangered species that may exist and/or occur within the permit area in <br />accordance with Rule 2.05.6(2)(a)(iii)(A). For each of the threatened and endangered species <br />listed in Section 2.04.11 of the permit that may exist and/or occur within the permit area, please <br />provide an plan that discusses impact control measures and management techniques that will be <br />utilized. <br />11. Please update Map #25 to depict and or label the following structures and renewable resource <br />lands: oil pipeline, County Road 107, Irrigation Ditches, Yampa River and Williams Fork River. <br />12. Page 2.05-52 indicates that three private residences are located within the permit area but are <br />outside of the planned mining area. Based on a review of Map 25 and Map 24, one private <br />residence is located within the proposed longwall panel north of the 10th East Gate Road. Please <br />update this section of the permit to indicate this. In accordance with Rule 2.05.6(6)(b), please <br />update this section of the permit to indicate the worst possible consequences which subsidence, <br />if it occurred, could have for this structure. Also please update the subsidence control plan for <br />the private residence to address the applicable requirements of Rule 2.05.6(6)(f). <br />Rule 2.07.7 — Conditions of Permits <br />
