H. Stream Buffer Zones <br />The Division has approved a variance for disturbance within designated stream buffer <br />zones for Tuttle Draw, Calamity Draw and Enstrom Draw. The variances were <br />discussed and approved in TR -83. <br />I. Probable Hydrologic Consequences <br />A detailed analysis of the Probable Hydrologic Consequences has been prepared by <br />ERMR and is contained in Section 2.05.6(3) of the permit application package. <br />Overall, the impacts of mining and runoff from the reclaimed areas to ground water <br />quality and receiving streams was found to be of minimal significance, although they <br />occur for a lengthy period of time. <br />J. Water Rights <br />The water augmentation plan is found in Section 2.05.6(3). ERMR has acquired <br />approval from the Colorado Water Court for this augmentation plan and has a completed <br />well permit for use of water from Pond 007. Demonstration for retention of Pond 007 <br />is found in Attachment 2.05.3(3)-16 of the permit. Attachment 2.05.3(3)-19 provides <br />the demonstration for retention of Pond 008. <br />IV. Topsoil <br />Topsoiling operations have been completed for areas east of 2700 Road, with the exception <br />of the support facilities area. Reclamation activities are continuing to the west of 2700 Road. <br />A. Salvage <br />Topsoil salvage thicknesses and stripping procedures are described in Subsection 16 of <br />Section 2.04.9. <br />No additional plans have been approved to salvage topsoil beyond what has currently <br />been disturbed. <br />B. Storage <br />This topsoil pile locations are illustrated on Map 2.05.4-9 and the details are described <br />in Section 2.05.4(2)(d) subsection 8.0. <br />C. Redistribution <br />Details regarding redistribution of topsoil are found in Section 2.05.4(2)(d). ERMR has <br />established multiple zones for topsoil replacement as shown on Maps 2.05.4-4 and <br />24 <br />
