Division immediately after data collection and analysis, and will be compiled and <br />summarized within an Annual Hydrology Report, to be structured around the <br />normal water year. <br />The Division has determined that Monitoring Wells GW -2, GW -4, GW -7, and GW -8 are <br />no longer necessary for impact monitoring of future bond release demonstration, and these <br />wells were sealed by the operator in 2007. GW -5 and GW -6 have been dry during all <br />monitoring events. The Division approved sealing of GW -5 and GW -6 in 2016, with <br />the approval of TR27. <br />D. Water Rights and Replacement <br />Portions of the application relevant to surface and ground water rights in the vicinity of <br />the mine were submitted to the Office of the State Engineer, Division of Water <br />Resources. The State Engineer's Office has determined that there are no problems with <br />the operation with respect to water rights. Water requirements for the operation and <br />water rights held by the operator are addressed in Sections 2.3.3 and 2.3.3.1 of the <br />application text, and in permit Appendix C. <br />The permit application contains information on water rights in the vicinity of the <br />operation, indicating that no ground water rights (springs or wells) have been <br />adjudicated within a three-mile radius of the permit area. One surface water right is <br />identified (H.G. McClane ditch) along East Salt Creek. It is highly unlikely that this <br />water right will be impacted by the operation. <br />The applicant has secured rights for 10 cfs discharge from the Mack Pumping Pipeline <br />for use at the mine. Total consumptive use projected for the Munger Canyon mining <br />operation, which was permitted to use water diverted from the same source, was less than <br />0.07 cfs. The applicant has demonstrated that rights have been secured to sufficiently <br />satisfy consumptive water use requirements for the operation. <br />The proposed operation is in compliance with the requirements of this section. <br />E. Stream Buffer Zones <br />The Division proposes to approve surface or underground mining activities within 100 feet <br />or through an ephemeral stream with a watershed of at least 1 square mile. This decision <br />is based on a finding that the original stream channel will be restored, water quality and <br />quantity shall not be adversely affected, and appropriate riparian vegetation will be <br />reestablished. The buffer zone variance was granted for the construction of an access road <br />to an emergency drill pad in Munger Canyon for access to underground workings of the <br />adjacent McClane Canyon Mine during winter months in 2005 and 2006. The emergency <br />access road and associated pad were constructed and reclaimed during winter months when <br />flow in the ephemeral Munger Creek was nonexistent or negligible. The reclaimed <br />disturbance area associated with this access road and drill pad were transferred to the <br />Munger Canyon Mine permit with the approval of TR28, November 14, 2017. <br />20 <br />
