Technical Revision No. 62 was received on September 7, 2016. The revision approved the <br />reclamation ofponds #1, #2, #3, #4 and the Refuse Disposal Area Pond associated with the <br />Bowie No. 1 Mine. The revision was based on a 2016 vegetation success study on the Upper <br />East Mine and the Lower East Mine Area. TR -62 was approved on December 19, 2016 and <br />issued on January 10, 2017. <br />Technical Revision No. 63 was received on January 22, 2018. The revision proposes to revise <br />the revegetation success standard that will be used for Phase III bond release at the East Mine, <br />West Mine and Run -of Mine Area. TR 63 is currently under review by the Division. <br />Permit Revision No. 5 was received by the Division on November 1, 2016. The revision <br />proposed to change the post mining land use at the Paonia Loadout from rangeland/undeveloped <br />and cropland to industrial. PR -5 was withdrawn on February 12, 2018. <br />Surety Release No. 6 was received on July 5, 2017. Bowie Resources, LLC applied for a partial <br />phase I and phase II release of 59.4 acres associated with the East Mine and the Run of Mine <br />Pond. The request was adjusted to a partial phase I request for 2.31 acre s associated with five <br />ponds at the East Mine and one pond at the Run of Mine Area, and a partial phase II request of <br />58.84 acres associated with the backfilled and graded areas at the East Mine. SL -6 was approved <br />on February 15, 2018. SL -6 reduced the reclamation liability for the Bowie No. 1 Mine by <br />$484,986.72. <br />Brief Permitting History <br />The Bowie No. 1 Mine was an underground mine which began operating in 1975 and was <br />permitted under the permanent state regulatory program in 1981. The mine was originally called <br />the Orchard Valley Mine and the original permittee of the 1981 permit was Colorado <br />Westmoreland, Inc. (CWI). The permit has been transferred twice; first to Cyprus Orchard Valley <br />Coal Corporation and then to BRL. <br />The original 1981 permit has been renewed six times prior to this permit renewal application. <br />Three permit revisions and mu technical revisions expanded the original permit area of 2,283.5 <br />acres to 8,859.9 acres. Permit Revision No. 4 reduced the permit area to its current 5,431 acres. <br />Six bond release applications have been submitted for the Bowie No. 1 Mine. The first, SL -1, was <br />a Phase I bond release request for the West Mine area that was subsequently withdrawn by the <br />operator. SL -2, approved in 2004, granted Phase I bond release on the West Mine area. SL -3, <br />approved in 2008, granted Phase I bond release on the Unit Train Loadout. SL -4 approved in <br />2013, was a Phase I bond release request for 40.15 acres at the East Mine. The acreage was <br />increased to 70 acres at the East mine for backfilling and grading the East Mine. SL -5 was <br />approvedin 2016. The bondrelease was for 1.0 acres of Phase I at the West Mine and a total of <br />23.3 acres of Phase II, 10.2 acres at the Run of Mine Area and 13.1 acres at the West Mine. SL -6 <br />was approved in February of 2018. SL -6 approved the release of 2.31 acres for Phase I associated <br />with five ponds at the East Mine and the one pond at the Run of Mine Area.
