Rational for Recommendation for approval over objections; <br /> Regular 112 Construction Materials Amendment Application, <br /> Front Range Aggregates, <br /> Parkdale Quarry, Permit No. M-1997-054 <br /> February 27,2008 <br /> Introduction <br /> On February 27,2008 the Division of Reclamation,Mining,and Safety ("Division") issued its <br /> recommendation for approval of a 112 Construction Materials Amendment Application,over objections. <br /> This document is intended to provide a basis for the Division's recommended approval over objections to <br /> the Parkdale Quarry amendment application,Permit No. M-1997-054. <br /> The Front Range Aggregates Amendment Application was found complete and considered filed with the <br /> Division on October 1st, 2007. The site is located approximately 10 miles west of Canon City,along the <br /> North side of Highway 50, Fremont County,Colorado. The Quarry is located in Section 11, 12,13 and 14, <br /> Township 18 South,Range 72 West. The current approved Post Mining Land Use is Range Land,the <br /> Proposed Post Mining Land Use is a lined and sealed reservoir. <br /> I) OBJECTIONS: <br /> The Division received written comments on the amendment application during the public comment period, <br /> which ended November 14th 2007,with one objection letter signed by eleven residents,of which six of the <br /> residents who signed the petition were couples residing in the same residence and were referred to as Mr. <br /> and Mrs.,on all notices sent to the parties from the Division. <br /> II) ISSUES RAISED BY OBJECTING PARTIES <br /> Issued raised by the objecting parties is listed below. The Division's response to objection issues follows. <br /> A) ISSUES WITHIN THE JURSDICTION OF THE DIVISION AND BOARD. <br /> 1. The proposed quarry operations wants a water storage as post mining land use rather than the <br /> standard reclamation,no one knows if our wells will run dry from using underground water to fill <br /> the proposed lake. <br /> Division's response. <br /> The operator des not plan to fill the reservoir with water from either the Arkansas River or from any <br /> ground water sources in the area. Front Range Aggregates has a well permit which allows them to use <br /> ground water during their operation,for such things,as washing the fines, dust suppression and other <br />
