�9 <br />March 27, 2018 <br />Page 2 <br />Colowyo: The Division is correct in their assumption about Topsoil Pile 36A, and it <br />should be covered in the overall reclamation liability for the entire mine site, but not <br />for the cumulative bond schedule or worst case scenario for the permit term. <br />Therefore, Topsoil Pile 36A has been removed from Exhibit 13C. Please removed <br />Topsoil Pile 36A from the Exhibit 13C reclamation cost estimate also. <br />The Division has removed Topsoil Pile 36A from the Exhibit 13C reclamation cost <br />estimate. Please see the attached updated Exhibit 13C reclamation cost estimate. <br />Response: Tri-State has reviewed the updated Exhibit 13C RCE provided by the <br />Division, and would request one change to the RCE. For Task 046 please revise the <br />overburden volume to 13,500,000. This revised volume has also been reflected in <br />Exhibit 13C, Table 13C-24. <br />9. Division: On proposed page 13 of Exhibit 13C, discussion states that the provided <br />information is through the end of year 2020. Similarly, to Item 8 of this letter, the <br />Division will be bonding/or all disturbances associated with the current disturbances <br />as well as up to the current permit term (years 2017 - 2021) with pending Renewal <br />No. 7. The Division feels that the differing dates can lead to confusion with the <br />reclamation cost estimate with no defining disturbance limits associated with 2020 <br />within the Colowyo PAP. Please provide defining disturbance limits for the <br />disturbances associated with the proposed activities within Exhibit 13C. <br />Colowyo: Per phone discussion between Mr. Tony Tennyson and Mr. Zach Trujillo in <br />regards to this comment a map (Map 13C-1) has been prepared and included in <br />Exhibit 13C to identify the areas planned/or disturbance under Exhibit 13C. The <br />Division should note that this area will be smaller disturbance footprint that is <br />contained on Map 35B in RN -07. Colowyo fully understands the areas shown on this <br />map and contained in Exhibit 13C will be the limiting factor of disturbance allowed <br />until Exhibit 13C is updated or Colowyo 's post the full bond amount required for the <br />permit term. <br />The Division has reviewed the proposed Map 13 C-1, Sheet 1 and Sheet 2 and have no <br />comments. <br />Item is resolved. <br />Response: No response is required as item has been resolved. <br />10. Item is resolved. <br />11.
