3/26/2018 State.co.us Executive Branch Mail-Fwd: Magpie Diversion inspection <br /> The Corley Company would like to request an inspection of the Magpie Diversion pursuant to 5.02.5. <br /> The permit violation issues are listed below. <br /> 1. The Diversion was constructed as a temporary diversion and surveyed in 1982. This survey was <br /> reproduced for Southfield in 1989 and was used for the certified as-built Southfield Map 25. It is <br /> impossible for this certification of the temporary diversion to be used for the certification of the <br /> permanent diversion construction done in 2001. There has never been a certification of the permanent <br /> Diversion by a qualified and registered professional engineer as required by 4.05.4(2) and 4.05.4(4). <br /> 2. There is an area on the north Diversion bank that is bare of rip-rap. This bare area has been noted <br /> in the monthly Southfield inspection reports as requiring repair for about fifteen consecutive <br /> monthly reports. <br /> 3. The north bank of the Diversion has less than the required freeboard as specified in the Southfield <br /> Map 25A. A survey certified by John H. Keilers, professional land surveyor, 23890, dated July 11, <br /> 2016, has been furnished to you. The inadequate freeboard height was confirmed by subsequent <br /> measurements performed by the Division. <br /> 4. The Diversion discharge culvert beneath the Monarch Fan Road has a damaged inlet, which <br /> damage reduces the inlet cross sectional area. The Federal Highway culvert tables do not provide flow <br /> data for damaged inlets, but it seems probable that the reduced inlet area will thereby decrease the <br /> flow and increase the inlet head water height. <br /> 5. The Diversion of Magpie Creek does not return the water to the original Magpie Creek at the culvert <br /> inlet. Instead the Diversion flow joins an unnamed creek at the culvert outlet, and the Diversion flow <br /> continues about three-quarters of a mile downstream, outside the Southfield permit area, and across <br /> the neighboring Warnock property where it rejoins the original Magpie Creek. <br /> This inspection request if being made now because of the approaching rainy season. Breaching of the <br /> north bank of the Diversion at the location of the inadequate freeboard may cause severe damage to <br /> the portal area reclamation. Diversion of the entire Magpie Creek flow via the unnamed creek drainage <br /> will result in excess sediment transportation from the permit area onto the adjacent landowner. <br /> [signed electronically] <br /> W.D.
