The big question about the Magpie Diversion is whether the Division has the right to approve the diversion of the
Magpie Creek flow to a different drainage outside of a permit boundary particularly upon and thru an adjacent owner's
property. To my knowledge that part of the Magpie Diversion has never been inspected for damage caused by
increased streamflow.

The Division does not believe there is a violation of the Act, or permit conditions required by the Act, or that
any imminent danger or harm exists that initiates Rule 5.02.5. The area of the channel embankment that
has been documented as'bare of rip rap' is considered a maintenance item and does not rise to a violation.
Additionally, the Division has only conducted rough measurements of the Magpie Diversion and not a
survey of the ditch. Currently, the Division and the Office of Surface Mining Reclamation and Enforcement
will be conducting a survey of the Magpie Diversion on a tentative date of April 4, 2018. Finally, based on
the inspections conducted by the Division since August 2001 and the approval of the Magepie Creek
Diversion as a permanent drainage, there are no reasons to believe imminent danger or harm
exists. However, the Division will be conducting its monthly inspection of the Southfield Mine on March 30,
2018 at 9:00 AM which is within 10 days of receipt of your inspection request.
Additionally, there have been recent organizational changes within the Division. Jim Stark has now been
promoted to the Division's Program Supervisor and Jason Musick has taken his old position as an EPS
Senior and my direct supervisor. I have remained the lead inspector for the Southfield Mine.
