Any discharge to the waters of the State from a point source other than <br />specifically authorized by this permit is prohibited. <br />B. PERMIT COMPLIANCE <br />In accordance with the Water Quality Control Commission Regulations for Effluent Limitations (Section 62.4), the Colorado Discharge <br />Permit System Regulations, Section 61.8(2), 5 C.C.R. 1002-61, and the federal Effluent Limitation Guideline for the Coal Mining Point <br />Source (40 CFR 434), the permitted discharge shall not contain effluent parameter concentrations which exceed the limitations <br />specified below or exceed the specified flow limitation. All discharges authorized under this permit shall comply with all the terms <br />and conditions required by this permit. Violation of the terms and conditions specified in this permit may be subject to civil and <br />criminal liability pursuant to sections 25-8-601 through 612, C.R.S. Failure to take any required corrective actions, as detailed in the <br />CORRECTIVE ACTIONS section, constitutes an independent, additional violation of this permit and may be subject to civil and <br />criminal liability. <br />1. Facilities Operation and Maintenance <br />The permittee shall at all times properly operate and maintain all facilities and systems of treatment and control which are <br />installed or used by the permittee as necessary to achieve compliance with the conditions of this permit. Proper operation and <br />maintenance also includes effective performance, and adequate laboratory and process controls, including appropriate quality <br />assurance procedures. This provision requires the operation of back-up or auxiliary facilities or similar systems when installed <br />by the permittee only when necessary to achieve compliance with the conditions of the permit. <br />Any sludge produced at the wastewater treatment facility shall be disposed of in accordance with State and Federal guidelines <br />and regulations. The permittee shall take all reasonable steps to minimize or prevent any discharge of sludge use or disposal in <br />violation of this permit which has a reasonable likelihood of adversely affecting human health or the environment. As <br />necessary, accelerated or additional monitoring to determine the nature and impact of the noncomplying discharge is required. <br />
