Exhibit S PERMANENT MANMADE STRUCTURES <br />There are no new permanent and man-made structures around <br />the amendment area than those listed in the 2005 application. <br />The structure closest to the slurry wall and excavation are the <br />Bromley wells and barn. The following pages are copies of the <br />Damage liability agreements for the 2005 amended area. Backfill area <br />- Well and house <br />United Power has elected not to sign a damage waiver but have <br />provided the attached guidelines for mining near their power <br />poles. The poles are located east of Bromley road or nearly 60 <br />feet from the closest point of mining. According to their <br />statement we are well outside their area of concern. From their <br />statement that is a 10 foot setback since the lines parallel the <br />road. <br />LaFarge West, Inc. has a slurry wall adjoining the property but <br />they will mine this area and plan to mine the slopes at 3:1 in <br />the reservoir area will mitigate how close they can come to the <br />wall. <br />17 <br />
