March 13 , 2018 <br /> Priola Pit - M-2007-087 <br /> Request for Technical Revision supplemental information. <br /> This Technical Revision request stems from past issues Albert <br /> Frei and Sons, Inc . is having with CAP Land Company (CAP) the <br /> owners . A Technical Revision (TR01) was filed in October 6 , 2015 <br /> to extend commencement of reclamation until April 20, 2019 . The <br /> Division approved the Technical Revision on March 22 , 2016 . This <br /> was Technical Revision is filed based on the Divisions Staff <br /> suggestions in the June 26, 2017 inspection report, page 3 <br /> paragraph 2 under Reclamation Success . In that suggestion the <br /> staff said a Technical Revision could be filed to change the <br /> reclamation plan to an as built configuration. After numerous <br /> attempts to resolve the issues with CAP it is now time for Albert <br /> Frei and Sons, Inc . to complete grading and seeding to stay <br /> within the timeframe allowed by the 2015 reclamation extension. <br /> This revision changes the final grade elevation to those complete <br /> to date (As Built) with the finished slopes being graded 3 : 1 or <br /> flatter as shown on the attached Revised TR02 Reclamation Plan <br /> Map. There is material on site at this time to complete the <br /> grading. The present condition, with the toe of the backfilled <br /> slope being closer to the permit line then originally approved, <br /> is a result of the property owners requesting that filling be <br /> done as close to the fence as practical to maximize the upper <br /> surface of the filled area for development . At this time that <br /> distance varies for as little as 6 inches to over five feet, as <br /> can be seen on the attached contour map prepared by Gillian Land <br /> Consultants on 2/2/18 (revised TR02 Current Conditions Map) . CAP <br /> also requested that the area around the large agricultural well <br /> be filled in and that was done after a riser was installed, by <br /> the owner, on the well . In addition the landowners, CAP, are <br /> using a section in the very northeast corner of the site as a <br /> slurry dump . This area will remain undisturbed by Albert Frei <br /> and Sons and the landowners will be responsible for reclaiming it <br /> since it was not part of our mining operation nor authorized by <br /> us . <br /> This Technical Revision changes <br /> • The toe of backfill to the fence distance from 25 feet <br /> to nearly touching it on most of the area.
