(v) Measures used to ensure that the interests of the public and <br />landowners are protected if: <br />(A) Surface miming facilities within 100 feet of a public right <br />of way: <br />Surface mining facilities do exist within 100 feet of a <br />public right of way. Since the train loadout and <br />stockpile were built prior to the passage of the state <br />and Federal mining and reclamation acts and the <br />promulgation of these regulations, these roads, <br />conveyors and rail systems were not particularly <br />constructed according to the specifications set forth in <br />this section. <br />(B) Relocating a public road. <br />A public road was re -aligned during the construction of <br />the stockpile. The realignment of this road included <br />the installation of an underground crossing for the rail <br />spur. <br />(vi) Stream fords. <br />There are no stream fords along the haul roads or access <br />roads within the Permit boundary of the train Ioadout and <br />stockpile areas. <br />(vii) No answer required. <br />RN -07 2.05-16 02118 <br />
