Transit Mix Concrete Co. <br /> 7) In Figure C-2, RMBC Group, LLC is shown to be the structure owner for a seep area <br /> identified within the mining area. Please provide clarification. <br /> Response: RMBC Group, LLC was listed as the owner as they are the landowner in the <br /> area of the feature. The seep is a natural, undeveloped feature that does not qualify as a <br /> "structure" under CDRMS definitions. The feature has been included on Figure C-2, but it <br /> is not a structure nor is it owned by anyone. The owner has been removed from <br /> Figure C-2. <br /> 8) Please confirm no significant, valuable, and permanent man-made structures are located <br /> within the 200 foot offset which overlaps parcels owned by Dry Head Ranch LLC, United <br /> States Government, and State of Colorado. <br /> Response: Figure C-2 has been updated with fencing located within 200 feet of the <br /> affected lands boundary. Transit Mix confirmed the fence locations and ownership with <br /> RMBC Group, LLC and verified the presence of fencing with biologists who traversed the <br /> area. <br /> 9) In Figure C-2, a structure owner is not identified for the dam located south of the Glen <br /> Cairn Reservoir. Please identify the owner for this structure on Figure C-2. <br /> Response: Figure C-2 has been updated to address this comment. The dam is owned by <br /> RMBC Group, LLC. <br /> 10) In Figure C-2, road locations appear to be indicated by both light yellow solid lines and <br /> dark yellow solid lines. However, the legend only includes the dark yellow solid line as a <br /> symbol for roads. If the Applicant intended to differentiate two types of roads, please <br /> provide the appropriate symbol and description in the legend. During previous site <br /> inspections, the Division observed Little Turkey Creek Road to be the only road present in <br /> the valley just north of the proposed quarry area. However, on Figure C-2 there are two <br /> roads identified in this valley, one marked by a dark yellow solid line and the other marked <br /> by a light yellow solid line. In comparing the figure with Figure C-1, it appears the dark <br /> yellow solid line represents Little Turkey Creek Road. However, the position of the dark <br /> yellow solid line appears to be shifted slightly southward from its position shown in Figure <br /> C-1. Please revise Figure C2 to correct these errors. <br /> Response: Figure C-2 previously included the correct surveyed location of the road and an <br /> incorrect alignment provided by spatial data clearinghouses. Figure C-2 has been updated <br /> to show only the surveyed location of the road. <br /> 11) The location of Little Turkey Creek appears to shift between Figures C-1 and C-2. For <br /> example, in Figure C-1, the creek aligns with the proposed permit boundary in the western <br /> and eastern portions of Section 16. However, in Figure C-2, the creek is shifted slightly <br /> north of the proposed permit boundary in these same areas.
